A RE.iOLUTION ORDERING ABATENZNT
OF EAZARDOUS BUILDING ACTION AT
LOT 3 BLOCK 5, CRYSTAL BAY VIEW
CHERRY PLACE, ORONO
WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota;

WHEREAS, F. Alan Schmidt, 1415 Cherry Place, Mound,
Minnesota, 55364; is the fee owner c)f record of property located
in Orono, Minnesota, herein referred to as "the property", and
legally described as follows:

WHEREAS, the City Council of the City of Orono, having
duly considered the matter pursuant t3 Minnesota Statutes
Sections 463.15 to 463.261, hereby finds that the above described
property is uninhabitable and contains unsanitary and hazardous
corditions which constitute a public nuisance'and which makes
this property hazardous to the public health, safety and welfare
based on the following f:�ndings:
1. Loft area has collapsed
2. Building open to public
?. Nein-conforming structure - no principal building
4. Wood rot throughot.it building
5. Junk and debris scattered around lot
6. Bui lding is in a state of deterioration and
di lapi ' tion, thus it is a safety and health hazard pursuant
to Minsiesota Stmt,? Building Code/Uniform Building Code,
Section 203.
7. Orders to retrove or repair the structure were issued by
the Building Official on May 1, 1986. These rders have not
been complied with.

NOW O THER.EPORE, BE IT RESOLV BD as f o I l ow s:
1 . That the City Counci 1 of the City of Orono, pursuant to
the foregoing findings and in accordance with Minnesota
Statutes Sections 463.15 to 463.261 hereby orders the
owner(s) of the property to raze and remove the structure on
the property. The Council further orders that all personal
property or fixtures that may unreasonably interface with
the razing be removed wit? -yin twenty (20) days of the service
of this order or the City of Orono may remove and sell such
personal property or fixtures at a public auction in
accordance with the law.
2. The City Counci 1 cf the City of Orono further orders
that unless this cor-ective action is taken or an answer is
served upon the City of Orono and f i led in the of f i ce of the
Clerk of District Court of Hennepin County, Minnesota,
within twenty (20) days from the date of the service of this
order, a motion for summary enforcement of this order wi 1 1
be made at District Court of Hennepin County.

against the romal estate described above for collection along
with taxes.
