HomeMy WebLinkAbout1986-03-10 Resolution #1938City of ORONO RESOLUTION OF THE CITY COUNCIL NO. 19 38 A RESOLUTION ORDBRING ABATEMENT OF HAZARDOUS BUILDING ACTION AT 1365 Cherry Place, Orono WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and. WHEREAS, Harold Haug, 6804 Hillside Lane, Edina, Minnesota, 55435; is the fee owner of record of property located at 1385 Cherry Place, Orono, Minnesota, herein referred to as the Property, and legally described as follows: Registered Land Survey 0615 Tract B MHBRRAS, the City Council of the City of Orono, having duly considered the matter pursuant to Minnesota Statutes Sections 463.15 to 463.261, hereby finds that the above described property is uninhabitable and contains unsanitary and hazardous conditions which constitute a public nuisance and which makes this property hazardous to the public health, safety and welfare based on the following findings: 1. Total water damage inside from leaking floor - ceiling fell. 2. Electrical is in very bad condition because of ;:he moisture. 3. Roof in poor condition. 4. Heating system in poor condition. 5. Hui lding is in a state of deterioration ; nd dilapidation, thus it is a safety and health hazard pursuant to Minnesota State Building Code/Uniform Building Code, Section 203. 6. Orders to remove or repair the structure were issued by the Building official on March 5, 1986. These orders have not. been complied with. That the City Council of the City of Orono, pursuant to the foregoing findings and in accordance with Minnesota Statutes Sections 463.15 to 462.261 hereby orders the owner(s) of the property to raze and remove the structure on the property. The Council further orders that a 1 1 personal property or fixtures that may unreasonably .interface with the razing be removed within twenty (20) days of the service of this order or the City of Orono may remove and sell sucn personal property or fixtures at a public auction in accordance with the law. 2. The City Council of the City of Orono further orders that unless this corrective action is taken or an answer is served upon the City of Orono and filed in the office of the Clerk of District Court of Hennepin County, Minnesota, within twenty (20) days from the date of the service of this order, a motion for summary enforcement of this order will be made at District Court of Hennepin County. 3. That the City Council of the City of Orono further orders that if the City is compelled to take corrective action herein all necessary costs expended by the City will be assessed against the real estate concerned and collected in accordance with Minnesota Statute, Section 463.22. 4.
