NATHAN Harold Haug 1390 North Ann Dr.1838 Ford Parkway St. Paul, Mn. 16 Dear This office is the City attorney for the City of Orono. Perhaps our records are not correct, however, the City records indicate that your residence or building at ... has not yet been connected to the available municipal sewer system. This letter is to inform you that if you are in fact not now hooked up to City Sewer, you are in violation of the Orono Municipal Code, Chapter 25, Section 25.160 which requires the owners of all houses, buildings, or improved properties where public sewer was available as of July 1, 1968, to connect to said public sewer not later than December 31, 1969, and the owners of all houses, buildings or improved properties where public sewer became available after July 1, 1968 to connect to said public sewer within sixteen (16) months after^e sewer was made available. ' Orono Ordinance No. 210, Chapter 22.20, ^-l reiterates this 16-raonth connection period requirement. Minnesota Health Department regulations MHD 120(e) and 122(g) require the connection to and use of public sewer facilities where they are available. This letter is final notice that the residence or building indicated above must be booked to the municipal sewer no later than August 1, 1979. Continued violation after that date will result in a tag being issued to you. Such a violation constitutes a misdemeanor. A misdemeanor may be punishable by a fine of not more than $500.00 or other penalties pursuant to the provisions of the statutes of the State of Minnesota. Each day of violation or non-compliance shall constitute a separate offense. POPHAM, Haik , Schnobrich , Kaufman & DofY, LtO. May 1, 1979 Page Two The City has previously given you what we feel is ample notice that the sewer connection must be made. We shall continue to provide all the help we can in accomplishing the required work, but the deadline will not be extended. Please cooperate in solving our mutual problem before a tag is issued. If you are on a limited income and the connection will create a financial burden, some assistance in the form of a grant or loan may be available. Please contact John Gerhardson, Public Works Director, Orono City Hall, at 473-7357. If our records are incorrect and your building is hooked up, please call Mike Gaffron at 473-7357 and inform him of that fact. Very truly yours. Bruce D. Malkerson City Attorney BDM/km
