Dear Mr. Davenport;
The City is in receipt of a letter dated October 1, 1987
stating your clients' willingness to indemnify the City and
hold it harmless from any costs or damages incurred by or
arising out of your clients' occupancy of their house should
the City Council deny the pending variance application. As you
are aware, the Uniform Building Code and other applicable codes
do not require the City to issue a Temporary Certificate of
Occupancy in this instance. However, the City is willing to
issue such a certificate in exchange for your clients' promise
not to claim additional damages arising out of their occupancy
of the house prior to City Council determination of what action
needs to be taken to remedy the grading that has occurred in
the 0-75 foot setback.
It is ray request that the letter submitted by Mr. Waters
and Ms. Molitor-Waters be revised to include the Mayor, City
Council, and the agents and employees of the City after each
reference to "the City" in your last paragraph. As discussed
during our phone conversation on October 1, the last paragraph
needs to state that your clients are willing to hold harmless
and indemnify the City for any costs it incurs due to any

claims made by your clients for damages or costs incurred or
arising out of your clients' occupancy of the house, including
but not limited to attorney and consultant fees.
Finally, the last paragraph of your clients’ letter also
needs to be clarified to state that the City will be held
harmless for any property damage arising out of their occupancy
prior to the issuance of a Certificate of Occupancy.
A formal application for a Temporary Certificate of
Occupancy can be made to the City staff. I have recommended
the issuance of such certificate provided the house meets all
applicable code regulations and your clients agree to fulfill
every condition required by City staff.
If you have any objections to or questions about the
contents of this letter, I request that you notify me by Monday
afternoon.
