C e Lusian, Clerk ail CITY OF ORONO RESOLUTION OF THE CITY COUNCIL t)A CZ y�l NO. 7533 .kESHoo' A RESOLUTION APPROVING VARIANCES FROM MUNICIPAL ZONING CODE SECTIONS 78-350; 78-1279; and 78-1680 FILE NO.LA24-000053 WHEREAS, on September 17, 2024, on behalf of the property owner, K E Levitt Et Al Rev Trust, Lecy Brothers Homes & Remodeling (hereinafter the "Applicant")applied for variances from the City Code for the property addressed 700 North Arm Drive and legally described as: Lot 2, Auditor's Subdivision No. 362, Hennepin County, Minnesota (hereinafter the "Property"); WHEREAS, the Applicant has made an application to the City of Orono for variances to Orono Municipal Zoning Code Section 78-350 to allow redevelopment of an existing lot that property area is 0.44 acre where 1.0 acre is required and width is 140 feet at the lake and 130 feet wide at the 75-foot setback where 140 feet in width is required; and WHEREAS, the Applicant has made an application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1279 to allow the construction of a new two-story home to be built on the existing home's footprint, 62.9 feet from the lake, including a deck set back 61.4 feet from the lake; and WHEREAS, the Applicant has made an application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1680 to reconfigure the hardcover within the 75-foot lake setback allowing 866 square feet of hardcover in the 75-foot setback where 1,118 square feet of hardcover currently exists in conjunction with redevelopment of the Property; and WHEREAS, on October 21, 2024, after publishing and mailing notice per Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which time all persons desiring to be heard concerning this application were allowed to speak thereon; and WHEREAS, on October 21, 2024, the Planning Commission recommended approval of the variances as applied; and WHEREAS, on November 12, 2024, the City Council voted 3 in favor and 1 opposed on a motion to approve the variances as applied and directed Staff to prepare findings for approval of the variances. - .0.Ar0 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL y i )!L"- ��4 NO. 7533 IkESHOV-S NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota hereby approves the requested variances as described above based on one or more of the following findings of fact concerning the Property: FINDINGS OF FACT: Al. The analysis contained within staff memos and the exhibits attached to the aforesaid memos, all minutes from the above-mentioned meetings, and all other materials distributed at these meetings are hereby incorporated by reference. A2. The Property is located in the LR-1 B, One Family Lakeshore Residential Zoning District. A3. The Property contains 0.44 acres in area and has a defined lot width of 140 feet at the ordinary high water level and 130 feet at the 75-foot setback where 1.0 acre in area and 140 feet in width are required. A4. The Property is within Tier 1 and hardcover is limited to 25% according to the Stormwater Quality Overlay District. A5. The Applicant has applied for the following variances: a. Lot Width Variance b. Lot Area Variance c. 75-foot Lake Setback Variance d. Hardcover within the 75-foot Lake Setback Variance A6. In considering this application for variances, the Council has considered the advice and recommendation of the Planning Commission and the effect of the proposed variances upon the health, safety, and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. ANALYSIS: 81."Variances shall only be permitted when they are in harmony with the general purposes and intent of the ordinance . . . ." The proposed variances are in harmony with the purpose of the Ordinance. The substandard lot has difficulties in its small size and depth, the location of the sewer line and easement in the street yard, the existing mature trees, and the existing home location making redevelopment of the Property difficult. 82."Variances shall only be permitted . . . when the variances are consistent with the comprehensive plan." The variances requested to support the construction of a new 2 gOt�O CITY OF ORONO RESOLUTION OF THE CITY COUNCIL y� NO. 7533 G `4kESHos" home in a similar location on this nonconforming lot are consistent with the comprehensive plan. B3."Variances may be granted when the applicant for the variance establishes that there are practical difficulties in complying with the zoning ordinance. 'Practical difficulties,' as used in connection with the granting of a variance, means that: a. The property owner in question proposes to use the property in a reasonable manner, however, the proposed use is not permitted by the official controls. The request to permit the construction of a new residence on the existing foundation on the substandard lot with a reduction in nonconforming hardcover is reasonable. b. The plight of the landowner is due to circumstances unique to his property not created by the landowner. The substandard lot size is an existing condition and there is no available land with which to make the property more conforming. The restricted rear yard and substandard lot size and shape are challenges not created by the owners. There should be consideration for variances for the property which is substandard in area and setback requirements. The project has been designed with an effort toward limiting new encroachments and hardcover without sacrificing functionality; and c. The variance, if granted, will not alter the essential character of the locality". The variances are requested to permit the construction of a new home utilizing the existing footprint, which is reasonable. B4."Economic considerations alone do not constitute practical difficulties." Economic considerations have not been a factor in the variance approval determination. B5."Practical difficulties also include but are not limited to inadequate access to direct sunlight for solar energy systems. Variances shall be granted for earth-sheltered construction as defined in Minn. Stat. §216C.06, subd. 2, when in harmony with Orono City Code Chapter 78." This condition is not applicable. B6."The board or the council may not permit as a variance any use that is not permitted under Orono City Code Chapter 78 for property in the zone where the affected person's land is located." This condition is not applicable, as a single-family residence is an allowed use in the LR-1 B District. B7."The board or council may permit as a variance the temporary use of a one-family dwelling as a two-family dwelling." This condition is not applicable. 3 Ot�O CITY OF ORONO RESOLUTION OF THE CITY COUNCIL Al NO. 7533 9kESH046' B8."The special conditions applying to the structure or land in question are peculiar to such property or immediately adjoining property." The Property's substandard size and shape (shallow depth), and sanitary sewer encroachment create difficulties that do not apply to many of the properties in the same neighborhood. The proposed setback and hardcover level are not out of character. B9."The conditions do not apply generally to other land or structures in the district in which the land is located." The Property's substandard size and width and sanitary sewer encroachment create difficulties that apply to very few properties in the City. Few of the neighboring properties have similar challenges. B10."The granting of the application is necessary for the preservation and enjoyment of a substantial property right of the applicant." The proposed footprint of the home does not encroach closer to the lake setback than the existing home. Granting of the lot area and width, setback, and hardcover variances are necessary for the preservation of the property rights of the owners. B11."The granting of the proposed variance will not in any way impair health, safety, comfort or morals, or in any other respect be contrary to the intent of this chapter." Granting the variances for lot area, lot width, hardcover, and setback in this situation is not contrary to the intent of the zoning chapter. B12."The granting of such variance will not merely serve as a convenience to the applicant, but is necessary to alleviate demonstrable difficulty." The variances for lot area and width, lake setback, and hardcover are necessary and do not merely serve as a convenience to the Applicant. CONCLUSIONS, ORDER AND CONDITIONS: Based upon one or more of the above findings, the Orono City Council hereby grants the following in conjunction with redevelopment of the Property: • A variance to Orono Municipal Zoning Code Section 78-350 to allow redevelopment of an existing lot where the area is 0.44 acre where 1.0 acre in area is required and having 140 feet of width at the lake and 130 feet at the 75-foot setback where 140 feet in width is required; • A variance to Section 78-1279 to allow the construction of a new two-story home to be built on the existing home's footprint, 62.9 feet from the lake, including a deck set back 61.4 feet from the lake; and 4 svOk CITY OF ORONO RESOLUTION OF THE CITY COUNCIL (11 )IL��q � . C2.The approved project shall conform to the survey dated 11/19/2024, hardcover calculations, and building plans submitted by the Applicant and annotated by City staff, attached to this Resolution as Exhibits A & B. • C3.Any amendments to the plans which are not in conformity with City codes may require further Planning Commission and City Council review. C4.Authorities granted by this resolution run with the Property not with the Applicants, but are permissive only and must be exercised by obtaining a building permit for the new construction and commencing construction of said project. A building permit must be obtained within one year of the date of Council approval, or the variance will expire on that date (November 25, 2025). C5.Violation of or non-compliance with any of the terms and conditions of this resolution may result in the termination of any authority granted herein.
