Tr <br /> `RIL- <br /> �OV0 <br /> CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> y�� G`� NO. 7528 <br /> ikESHo4tt <br /> A RESOLUTION TO APPROVE <br /> ACQUISITION,OF LAND FROM HENNEPIN COUNTY <br /> AND <br /> TO APPROVE A PURCHASE AND SALE AGREEMENT <br /> FOR RECONVEYACE OF PROPERTY <br /> WHEREAS,the real property legally described as Lot 46, Block 1, Stonebay, Hennepin <br /> County, Minnesota, PID 33-118-23-11-0049 (the "Property"), is offered for sale by the County <br /> Auditor of Hennepin County, as Administrator of State of Minnesota Tax-Forfeited Lands (the <br /> "County Auditor"); and <br /> WHEREAS,the Property was previously owed by The StoneBay Community <br /> Association ("Association") as a common element parcel,but it was forfeited due to non- <br /> payment of special assessments certified by the City of Orono for tax years payable 2008 and <br /> 2009, for unpaid utility bills; and . <br /> WHEREAS,the City of Orono is willing assist the Association in reacquiring the <br /> Property for use as a common element parcel; and <br /> WHEREAS,the City of Orono desires to purchase the Property from Hennepin County <br /> for$1.00 plus filing fees and any other applicable fees required, and has negotiated a Purchase <br /> and Sale Agreement with the Association; and <br /> WHEREAS,Minnesota Statutes §462.356, subd. 2, requires that the Planning <br /> Commission review the City's proposed acquisition of real property for compliance with the <br /> comprehensive plan and to report to the City Council in writing its findings; and <br /> WHEREAS, Minnesota Statutes § 462.356, subd. 2, provides for an exception from the <br /> requirement for review by the Planning Commission upon 2/3 vote of the City Council <br /> dispensing with the requirement and finding that the acquisition or disposal of the real property <br /> has no relationship to the comprehensive municipal plan. <br /> NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Orono: <br /> 1. City Council finds that the acquisition of the Property under the Purchase <br /> Agreement has no relationship to the comprehensive plan. <br /> 2. Review by the Planning Commission of the acquisition of the Property is <br /> hereby dispensed with. <br />
