HomeMy WebLinkAboutResolution 7529 Cancelling Special Assessments *Aro CITY OF ORONO RESOLUTION OF�THE CITY COUNCIL ikES Hos' NO. 529 A RESOLUTION CANCELLING SPECIAL ASSESSMENTS FOR LOT 46,BLOCK 1, STONEBAY, HENNEPIN COUNTY, MINNESOTA WHEREAS, City of Orono had assessed the real property legally described as Lot 46, Block 1, StoneBay, Hennepin County, Minnesota, PID 33-118-23-11-0049 (the "Property"), the common element parcel of The StoneBay Community Association (the "Association"), for tax years payable 2008 and 2009, for unpaid utility bills; and WHEREAS,pursuant to Minnesota Statutes § 429.101, on October 18, 2007, the City Council approved the certification of delinquent utility bill, including $8,294.35 for the Property, to Hennepin County for collection as a special assessment against the Property; and WHEREAS,pursuant to Minnesota Statutes § 429.101, on October 27, 2008, the City Council approved the certification of delinquent utility bill, including $5,127.95 for the Property, to Hennepin County for collection as a special assessment against the Property; and WHEREAS,neither the Association nor its predecessor in interest in the Property submitted payment to Hennepin County for the special assessments against the Property, and the Property was tax forfeited in 2012; and WHEREAS,the City is willing to work with the Association to return the parcel back to the Association with a Purchase and Sale Agreement, which was approved by the City Council of the City of Orono on November 25, 2024, by Resolution No. 7528; and WHEREAS,pursuant to the terms of that Purchase and Sale Agreement, the City agreed to purchase the Property from the County Auditor of Hennepin County, as Administrator of State of Minnesota Tax-Forfeited Lands; to waive the City's right to reassess the Property pursuant to Minnesota Statutes § 429.071, subd. 4; and to waive the collection of the special assessments, including the principal, interest, fees and penalties incurred to date. NOW THEREFORE, BE IT RESOLVED by the City Council of the City.of Orono waives reassessment of the Property in the amount equal to the original special assessments, including the principal, interest, fees and penalties.
