A RESOLUTION TO APPROVE
ACQUISITION OF LAND FROM HENNEPIN COUNTY
AND
TO APPROVE A PURCHASE AND SALE AGREEMENT
FOR RECONVEYACE OF PROPERTY
WHEREAS, the real property legally described as Lot 46, Bloclz 1, Stonebay, Hennepin
County, Minnesota, PID 334 18-234 1-0049 (the "Property"), is offered for sale by the County
Auditor of Hennepin County, as Administrator of State of Minnesota Tax -Forfeited Lands (the
"County Auditor"); and
WHEREAS, the Property was previously owed by The StoneBay Community
Association ("Association") as a common element parcel, but it was forfeited due to non-
payment of special assessments certified by the City of Orono for tax years payable 2008 and
2009, for unpaid utility bills; and
WHEREAS, the City of Orono is willing assist the Association in reacquiring the
Property for use as a common element parcel; and
WHEREAS, the City of Orono desires to purchase the Property from Hennepin County
for $1.00 plus filing fees and any other applicable fees required, and has negotiated a Purchase
and Sale Agreement with the Association; and
WHEREAS, Minnesota Statutes §462.356, subd. 2, requires that the Planning
Commission review the City's proposed acquisition of real property for compliance with the
comprehensive plan and to report to the City Council in writing its findings; and
WHEREAS, Minnesota Statutes § 462.356, subd. 2, provides for an exception from the
requirement for review by the Planning Commission upon 2/3 vote of the City Council
dispensing with the requirement and finding that the acquisition or disposal of the real property
has no relationship to the comprehensive municipal plan.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Orono:
1. City Council finds that the acquisition of the Property under the Purchase
Agreement has no relationship to the comprehensive plan.
2. Review by the Planning Commission of the acquisition of the Property is
hereby dispensed with.

Authorizes the City's purchase of the Property from the County Auditor.
4. Approves the Purchase and Sale Agreement between the City and the
Association, and authorizes the reconveyance of the Property to the
Association pursuant to the terms and conditions of that Purchase and Sale
Agreement.
The Mayor and City Administrator are authorized and directed to execute the
Purchase and Sale Agreement, and the Mayor and City Administrator are
authorized and directed to execute all documents, and take all appropriate
measures to acquire the Property pursuant to the terms of the County Auditor.
Adopted by the City Council of Orono, Minnesota at a regular meeting held on November 25,
2024.
