Minnesota 55.32.'i*Municipal Offices <br />On the North Shore of Lake Minnetonka <br />May 25, 1982 <br />Ga^ Barr_______________ <br />Casco Point RoaSt^ <br />Wayzata, MN 55T9T <br />Dear Mr. Barr: <br />This letter is written in response to your request of the City of <br />Orono to issue a building permit to allow the construction of a <br />swimming platform/raft off a tax forfeited parcel legally described <br />as R.L.S. #461, Tract V on Casco Cove, Lake Minnetonka. The proposed <br />structure will be located 3 feet from the shoreline and measure <br />approximately 4' x 25*. Your residence lot is separated from the <br />tax forfeit lot by an unimproved platted access road shown as Maple <br />Avenue. <br />The Hennepin County Department of Taxation has given you permission <br />to construct the floating platform off the above referenced tax <br />forfeited land subject to the approval of the City of Orono. As <br />I advised you before, staff would have to refuse your request <br />finding it a violation of the enclosed ordinances. Please review <br />Ordinance 3.01 Subdiv 5, Ordinance 3.02 Subdiv 2 (a), (b), (c), <br />Ordinance 3.02 Subdiv 9 (c), Ordinance 3.02 Subdiv 10 and Ordinance <br />3.021 (b). <br />You should be aware that the City Council has formally requested <br />by Resolution that the DNR and Hennepin County release this land <br />for sale for private use which they refuse to do. <br />Other neighboring property owners have expressed the Scune or similar <br />requests for this seune property and have been treated equally by <br />the City with each such request being denied. <br />I have enclosed a land use application for your convenl'i^nce, that^ <br />is if you still wish to proceed with the variances. Once again, it <br />is my responsibility to advise you that such an application will <br />undoubtedly be denied by the Council.
