HomeMy WebLinkAbout#5580 - variances � o� o �z� o � ���.�, ;, CITY of ORON� � � �� n�:-�. 4 .�� ti �'',� r �j'�' RESOLUTION OF THE CITY COUNCIL �`�kESYi�4� N0. �J 5 B �) A RESOLUTION GR.ANTING VARIANCES TO MUNICIPAL ZONING CODE SECTION 78-1405 SUBDIVISION 7 FILE NO. 07-3260 WHEREAS, Roger D. 0'ShaugYulessy, a single person (hereinafter "the applicant") is the owizer of the property located at 1265 Bracketts Point Road within the City of Orono (hereinafter the "City") and legally described as follows: Attached as Exhibit A, Hennepin County, Minnesota (hereinaiter the "property"}; and WHEREAS, the applicant has made application to the City of Orono for an after- the-fact variance to Orono Municipal Zoning Code Section 78-1405 (7) to allow construction of a fence 60" in height where 42" maximum height is pennitted. The property is located in the LR — 1 A Lakeshore Residential Zoning District which requires a minimum lot area of 2.0 acres and a minimum lot width of 200'. 3. The Planning Commission reviewed this application at a public hearing held on January 16, 2007 and recommended approval of the fence height variance based on the following findings: a. The applicant's property is a corner lakeshore lot abutting County Roud 15 as well as Bracketts Point Road. The code language regarding fences along roadways for comer lakeshore lots abuttin� a major thoroughfare and a local street is ambiguous. b. The wrouQht iron fence is not out of character with the neiQhborhood. The fence helps to address the security issues the applicant has identified. d. The height variance request is reasonable considering all of the above findings. 4. The City Council has considered this application includin� the followin� findings and recomrnendation of the Plaruiing Commission, reports by City staff, comments by the applicant and the public, and the effect of the proposed variance on the health, safety and welfare of the coirllnunity: a. The wrought iron fence is 60" as opposed to 72" which is the maximum height fence allowed in aily district. Tlie applicant has not c�nstructed the highest fence possible. b. The fence is darlc in color with decreases its visibility within its surroundings. c. The desi�l of the fence is such that it has a very low level of opaqueness, thus the visual impact of the fence is minimal. Further when mature, the vegetation surrounding the fence should offer ma;cimum screzning. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a denionstrable hardship, or difficulty; is necessary to preserve a substantial property ri�ht of the applicant; and would be in keeping with the spirit and intent of the Zonin� Code and Comprehensive Plan of the City. CONCLL'SIONS, ORDER AND C0:�IDITIO�'S Based upon one or more of the above findings, the Orono City Council hereby �rants a variance to Orono Municipal Zoning Code Section 78-1405 Subdivision 7 to allow a 60" wrought iron fence where a fence 42" maximum heiQht is pern�itted, subject to the following conditions: 1. Council approval is based on the site �lan submitted by the applicant and annotated by City staff, attached to this Resolution as Exhibit B. Authorities granted by this resolution ntn with the property not with the applicant, but are permissive only and must be exercised by obtaining a building peinzit for the new construction within one year of the date of Council approval, or the variance will expire on that date (February 26, 2008). 3. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall Ue punishable as a misdemeanor. � 4. The undersigned applicant has read, understauds and hereby agrees to the tenns of this resolution and on behalf of the applicant and the applicant's heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of tlie property.
