ii7 U3«H ’ ^ W#-; I « RESai/riCN NO, 828 RESOUT-ION VACATING PART OF CENnWL AVENUE IN THE CirV OF ORONO WHEREAS, the City of Orono has received a petition dated Jtdy 5, 1977, requesting vacation according to law of that part of Central Avenue abutting the property of Stewart Perry at 2975 Casco Point Road; and WHEREAS, after due published and posted notice, a public hearing was ileld eft August 1, 1977, before the Orono Planning Coninission when all interested persons were given an opportunity to be and WHp^, no other property is affected by said vacation aad nO objections were heard at the public hearing; and « WHEREAS, the travelled portion of Casco Point Road (Central Avenue) does not pass over any ? snd to be vacated; ^d WHEREAS, tJie Planning Comnission and City Couicil finds that the vacation would place the legal right-of-way boundary ccwisistent with telegraphy and the actual location of public and private inprovements as maintained for many years; and MIERE^, the City of Orono will retain sufficient right-of-way to insure proper road, utility and drainage construction and maintenance; and . WHERE^, the City of Orono finds it to be in the public interest to vacate the portion of Central Avenue described herein; WCM, THEREFORE, BE IT RESOLVED, that the City of Orono will vacate to Net. Pefiy for attachment to his property: That part of Central Avenue, according to the recorded plat of Sprint Paric, Lake Minnetonka, lying Northerly of the Southeasterly line of lx)t 89, said Spring Park, and its Northeasterly extension, lying Southerly of a line drawn parallel with and 75 feet Northwesterly, ^asured at ri|iit angles, from said Southeasterly line of Lot 89 and its Noi^astcrly extension, and lying westerly of a line drawn parallel with and 30 feet Westerly, measured at ri^t angles, from the following described line: Comnencing at the most Westerly comer of Lot 103, said ^rlng Park, Lake Minnetonka; thence on an assumed bearing of North 47 degrees 14 minutes 30 seconds East along the Northwesterly line of said Ut 103 a distance of 95.74 feet to the point of beginning of the line being described, said point being a point in a non-tangential curve concave to the West having a radius of 445 feet, a tangent of said curve through said point of beginning bearing North 15 degrees, 56 niiuites, 30 seconds West; thence 55oi?theast? jjy along said curve through 8 central angle of 6 degrees, 53 minutes, 30 seconds an arc distance of 55.52 feet; thence South 9 decrees 03 minutes East tangent to said curve a distance of 200 feet; thence along a ti^gential curve to the left having a radius of 280 feet ami central angle of 37 degrees, 40 minutes a distance of 184.07 feet, and there ending. .
