4* The hardcover can be further reduced by removal of 277 s.f. of
patio blocks adjacent to the proposed deck.
S. The wood play structure located near the 168 s.f. patio will not
encroach on any lake views enjoyed by neighbors.
6. The City Council has considered this application including the
findings and recommondatlono cf the Planning Conaiisaion. reports by
City staff, comments by the applicant and the effect of the proposed
variance on the health, safety and welfare of the cocasunity.
7. The City Council finds that the conditions existing on this
property are peculiar to it and do not apply generally to other
property in this soning district; that granting the variance would not
adversely affect traffic conditiona, light, air nor pose a fire haxard
or other danger to neighboring property; would not merely serve as a
convenience to the applicant, but is necessary to alleviate a demon
strable hards.hip or difficulty; io necessary to preserve a substantial
property right of tho applicant; and would be in keeping with the
spirit and intent of the Zoning Code and Comprehensive Plan of the
City.

Based upon ’.ns or more of the findings noted above, the Orono
City Council hereby grants a variance per Municipal toning Code Section
10.22, Subdivision 1 4 2 to penait the construction of a aecood story deck
which encroaches 12* into the average lakeshore setback sene where so
encroachment is normally allowed, and which results in a net decrease in
hardcover in the 75-250* lakeshore setback tone from 45,11 existing to
44.61 where only 251 hardcover is normally allowed, subject to the
following conditional
1. Applicant shall remove 168 s.f. of hardcover contained within the
block patio located at the southerly corner of the house (see Exhibit
A attached). Applicant ahall also remove 277 s.f. of patio blocks
adjacent to and not under the proposed deck. The 110 s.f. play
structure is allowed to retrain, final hardcover on the property is
el lowed as follows and per the hardcover worksheet attached mm tahLibit

Council approval» or this variance will expire on that date (October

The undersigned applicant have read* understood and hereby agrees
