Harvey F. Klosterman and his sister, Mrs. Dorothy K. Waterous , have
commenced a proceeding to register the title to certain property on
Casco Point in "Winship's Subdivision of Lot 1, Spring Park, 2nd
Division".
We are representing Louis W. Anderson, who owns property immediately
to the South of parcel 1, described in the Torrens proceeding, and we
ar, also representing Charles J. Twedt who owns property imsediately
South of parcel 2 described in said Torrens proceeding.
The said Torrens proceeding seeks to register the title to all of Spring
Street which lies between Blocks 2 and 3, said Winship's Subdivision.
There has never been a formal vacation of this street by the Orono Town
Board or the Orono Village Council, and because if title to this street
were acquired by Klosterman and Waterous by this Torrens proceeding, our
client, Mr. Twedt could not get from the West side of this property to the
East side of his property by land.
I would greatly appreciate it if this matter could be given to the Village
Attorney so that he could get in touch with me about the matter, and I also
appreciate it if the council would instruct the village attorney that the title
to this Spring Street should not be abandoned to private ownership. It is
part of the public domain and should not be given up but should be kept by
the public for the use of the public, especially in view of the fact that
the street loves access to the water of Lake Minnetonka.
I would appreciate hearing from you or the village attorney in answer to
this letter.
