HomeMy WebLinkAboutResolution 6054 � o� � - o 0 � � CITY of ORONO ti �'�� �G~' RESOLUTION OF THE CITY COUNCIL �kEsi;��' rvo. 6 0 5 4 A RESOLUTION APPROVING THE PLAT OF WOODHILL SENIOR COTTAGES FILES#10-3471 AND #11-3511 WHEREAS, the Ciry of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono (hereinafter"City Council") has adopted subdivision and land development regulations for the orderly, economic and safe development of land within the City; and WHEREAS, on June 13, 2011, the City Council considered the application by Klingelhutz Development Co., and Woodhill Senior Cottages LLC (hereinafter the � "Developer") for platting and a conditional use permit and site plan for development of property located at 2525, 2535, and 2545 Shadywood Road and legally described as follows: EXHIBIT A, ATTACHED (hereinafter the "Property"); and WHEREAS, on December 13, 2010, the City Council adopted Resolution No. 6001 granting Preliminary Plat Approval and Resolution No. 6002 granting conditional use permit approval for the proposed development of a one-lot plat to construct one building for residential memory care purposes; and WHEREAS, the Developer has completed or has agreed to complete all other requirements of the platting regulations of the City including: 1. Completion of all platting requirements of Preliminary Plat Resolution No. 6001. 2. Dedication on the plat of perimeter Drainage and Utility Easements as required in Resolution No. 6001. 3. Designation and dedication on the plat of wetlands subject to City and other agency jurisdiction, and granting of the standard Permanent Flowage and Conservation Easement and Restrictive Covenants for wetlands and wetland buffers. t Page 1 of 2 � O� r - 0 � ,� ., � C ITY of ORONO ti ��� �G~' RESOLUTION OF THE CITY COUNCIL `9$Egg,Og' NO. _yr n�_ 4. Dedication of conservation easements for the protection of wetlands, wetland buffers as shown on the plat of Woodhill Senior Cottages and documented in Preliminary Plat Approval Resolution No. 6001. 5. Provision to the City of a title opinion for the Property and certified copies of all recorded easements currently affecting the Property. 6. Submittal of any grading plan revisions that may be required by the City Engineer. NOW, THEREFORE, BE IT RESOLVED that based on the findings of Resolution No. 6001, the City Council of the City of Orono does hereby approve the plat of WOODHILL SENIOR COTTAGES, Hennepin County, Minnesota (a copy of which is attached as Exhibit B) subject to the following conditions: 1. Development within Woodhill Senior Cottages is subject to the Conclusions, Orders and Conditions enumerated within Preliminary Plat Resolution No. 6001 and Conditionat Use � Permit and Site Plan Approval Resolution No. 6002. 2. The approvals granted in this Resolution shatl become effective only when all conditions of approval requiring actions by the Developer have been satisfied. 3. The City Clerk shall release the plat documents for filing only upon certification by the City Attorney, Planning & Zoning Coordinator and City Engineer that all requirements of the platting regulations have been satisfied. 4. The aforesaid plat shall be filed by the City of Orono with the Hennepin County Registrar of Titles O�ce on or before December 13, 2011 together with a certified original copy of this resolution and executed copies of the easements and covenants pertinent thereto. The approval granted by this Resolution shall expire six months from approval date (December 13, 2011) if the conditions of this Resolution have not been met or the plat has not been filed by the date specified above. In that event, it will be necessary to file a new application with the City of Orono for subdivision review. Adopted by the City Council of Orono this 13�'day of June, 2011.
