HomeMy WebLinkAboutResolution 6089 E } � O� � 0 � � CITY of ORONO RESOLUTION OF THE CITY COUNCIL �� ti� � No. 6 0 8 9 ��kEsH�4� A RESOLUTION APPROVING A PRELIMINARY PLAT FOR THE FOLLOWING PROPERTIES/PIDS: 08-117-23-33-0030; 08-117-23-33-0031; 08-117-23-33-0032; 08-117-23-33-0033; 08-117-23-33-0034; and 08-117-23-33-0035 FILE NO. 11-3526 WHEREAS, 3515 Capital Partners, LLC, a Minnesota Limited Liability Company, (hereinafter the "Developer") is the owner of the properties within the City of Orono (hereinafter the "City") identified as property identification numbers (PIDs) 08-117-23-33-0030; 08-117-23- � 33-0031; 08-117-23-33-0032; 08-117-23-33-0033; 08-117-23-33-0034; and 08-117-23-33-0035 _ which are legally described as follows: Lots 8 through 13, Block 6, Crystal Bay View, Hennepin County, Minnesota (hereinafter the "Property"); and WHEREAS, on August 17, 2011, the Developer filed a complete application with the City for preliminary approval of a 3 lot residential plat of the Property; and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono Zoning and Subdivision Codes, on September 19, 2011, the Orono Planning Commission held a public hearing for the application at which time all persons desiring to be heard concerning the application were given the opportunity to speak thereon; and WHEREAS, on September 19, 2011, the Planning Commission reviewed the application and recommended on a vote of 6 to 0 that the City Council grant preliminary plat approval; and WHEREAS, the City Council reviewed the proposal at regular meetings held on October 10, and October 24, 2011, and hereby made the following findings with regards to this application: FINDINGS �._ 1. The Property is zoned LR-1 C Single Farnily Lakeshore Residential District, which normally requires a minimum lot area of 0.5 acres and minimum lot width of 100'. The Property totals 1.23 acres in area (53,578 square feet) and has 180 feet of width along Maple Place. a. The six individual, existing lots are each 9,000 square feet in area and have 50 feet in frontage width on Maple Place. 3. The proposed plat includes combing six lots into three lots. Each lot will be served via Maple Place. Each lot has a building site meeting the LR-1 C setback standards. 4. Development of existing non-conforming properties within the Shoreland Overlay District is governed by MN State Statute 462.357 as well as MN Rules, chapter 6120. 5. As proposed, the six individual, existing lots meet the requirements of MN §462.357 and MN Rule 6120. � , 6. Development of the Property in accordance with MN §462.357 and MN Rule 6120 limits each lot to a maximum of 25% hardcover where, according to the City's hardcover zone allowance, 30% hardcover is normally allowed. 7. The Developer's proposal to combine the existing six lots into three lots with 18,000 square feet in area and 100 feet in width results in a density of 2.7 units per acre and is consistent with Orono's 2008-2030 CMP guiding for this area as Low-Medium Residential with a density of 2-3 units per acre. 8. The Property will be served with City sewer. 9. Proposed Lots 1 and 2 will be served by private water supply wells. Lot 13, Block 6, Crystaf Bay View was assessed for City water in 1970; proposed Lot 3 will have the option of constructing a private well or connecting to City water. 10. The Property is identified in Orono's Surface Water Manaaement Plan (Jan 2011) as being located within a drainage area (NA-9) which is a sub-part of the North Arm drainage area. The Property is at the low point of the neighborhood drainage area. Storm water facilities should be located within the Property to serve the neighborhood and the Property. 11. The Developer has proposed a grading plan to establish building pad locations and elevations. The proposed elevation of the building pads will be used to establish new existing grades for the purpose of evaluating building height. ��_ Page 2 of 7 � o� � O � O CITY of ORONO � � �+ RESOLUTION OF THE CITY COUNCIL � '�, � ��� No. 6U89 � �`�k'ESHOg'� CONCLUSIONS, ORDER AND CONDITIONS NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the findings noted above, the City Council of the City of Orono hereby grants Preliminary Plat Approval for a 3-lot plat per the Pre imi ary Plat survey/drawing by Mark S. Gronberg of Gronberg & Associates, Inc. dated !0 3 and attached hereto as Exhibit A, subject to the following conditions: 1) Approval is subject to Minnehaha Creek Watershed District (MCWD) approval and permits as required. Final plat approval shall not be granted until the Developer has provided evidence that all required MCWD permits have been obtained. 2) The Preliminary Plat approval granted by this Resolution shall expire one-year from the approval date (October 24, 2012). 3) The Developer shall construct the required storm water pond/facilities on the Property. � _ 4) The City will construct and install off-site storm water facilities to be paid for via the Stormwater Fund. 5) The Property is limited to 25% hardcover per MN §462.357. 6) Development Fees. a) Park Dedication Fee. The development is not subject to the standard Park Dedication Fee requirement because no additional residential lots are being created. b) Storm Water and Drainaqe Trunk Fee. The development is subject to the standard Storm Water and Drainage Trunk Fee of $4,990 per acre x 1.239 total acres = $6,185.95. c) Metropolitan Council Sewer Availabilitv Charqe. Three properties are proposed to be connected to City sewer. The 2011 Met Council's SAC rate is $2,230 per unit. 3 units x $2,230 = $6,690 to be collected for pass through to Met Council at the time of the building permit issuance for each lot (subject to annual Met Council rate increases). d) Sewer Connection Charges. The sewer connection charges were assessed for existing Lots 8 through 13 with the 1965 sewer project. No City sewer connection charges will be due at the time of connection. � 7) Approval is subject to the existing and ongoing recommendations of the City Engineer. The following plans and specifications shall be submitted for review and approval by the City and other appropriate jurisdictions prior to final plat approval, to ensure that the proposed plat will accomplish the intended purposes: a) Final grading, drainage and erosion control plan showing existing and proposed contours, anticipated building locations, elevations, stormwater facilities and calculations, utilities and erosion control measures to be used during construction. Final Plat Approval wilf not be granted until the Minnehaha Creek Watershed District has approved the stormwater management plans. b) Su�cient detail to meet the recommendations of the City Engineer. 9) Other Easements. a) Drainage and Utility Easements shall be dedicated to the public on the final plat 10' � along all exterior property lines, and 5' either side of interior property lines, except such easements shall be increased to accommodate drainage where required, subject to City staff approval. b) A Drainage and Utility easement shall be dedicated to the public on the plat over the storm water pond area and storm water facilities. FINAL SUBMITTALS The following list of final submittals must be submitted to the Planning & Zoning Coordinator at least four (4) weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of the month. These submittals are as follows: 1. Record plat drawings in the form of two (2) mylar copies (one copy for the City's records and one for filing with Hennepin County) and one (1) copy reduced to 1" = 200'. Drawing to include: A. Lot lines p�per preliminary plat survey/drawing by Mark S. Gronberg dated 0 attached hereto as Exhibit A, except as modified herein. B. Dedication of "drainage and utility easements" 10' along exterior property lines, 5' along the interior property lines and over the storm water pond and facilities. D. Legal documents required: A. Title opinion addressed to the City or a title insurance policy in favor of the City. All owners, mortgage holders or others with property interest indicated therein shall sign the plat and all other documents affected by such interest. B. The applicant must provide certified copies of all recorded easements currently affecting the property. C. Signed Developer's Agreement. D. Signed Storm Pond Easement. 3. Plat approval fees to be paid: Total due: $7,165.95. �, A. Final plat fee: $700.00 B. Legal review & filing fees for subdivision and associated documents: $280.00 C. Park Dedication Fee: $NONE D.
