LA24-000038 WHEREAS, on June 19, 2024, Lake West Development(hereinafter"the Applicants"), the owners of the property, applied for an interim use permit for grading for the properties addressed 3245 Wayzata Boulevard and legally described as: Attached as Exhibit A(hereinafter the "Property"); WHEREAS, the Applicants have made an application to the City of Orono for an interim use permit (hereinafter the "IUP" pursuant to Orono Municipal Zoning Code Sections 78-916 and 78-1726)to allow 9.86 acres 429,501 sq.ft. of disturbance on the Property to consolidate contaminated soil in a berm on-site; and WHEREAS, on July 15, 2024, after published and mailed notice in accordance with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, on July 15, 2024, the Planning Commission recommended approval of the IUP as described; and WHEREAS, on August 12, 2024, the City Council reviewed the application and the recommendations of the Planning Commission and City staff; and NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota hereby approves the requested IUP as described above based on one or more of the following findings of fact concerning the Property: FINDINGS OF FACT: Al. The analysis contained within staff memos and the exhibits attached to the aforesaid memos, all minutes from the above-mentioned meetings, and all other materials distributed at these meetings are hereby incorporated by reference. A2. The Property is located in the RR-1 B, One Family Lakeshore Residential Zoning District. 1 iiL.Q U CITY OF ORONO RESOLUTION OF THE CITY COUNCIL t No. 7501 d` G l4kESHO A3. The Property contains approximately 29 acres in area. A4. The Applicants have applied for an IUP for grading. A5. In considering this application for an IUP, the Council has considered the advice and recommendation of the Planning Commission and the effect of the proposed IUP upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. INTERIM USE PERMIT ANALYSIS: The Council has determined that the proposed use will comply with the following IUP criteria outlined in Code Section 78-1726: B1.The use is allowed as an interim use in the applicable zoning district; Grading activities are permitted within the RR-1 B Zoning District. This criterion is met. B2.The use will not delay anticipated development or redevelopment of the site; The grading activities will allow for future site development on part of the site by remediating the contaminated soil. A portion of the site will still hold contaminated soil and would need additional remediation before development could take place. This criterion is met. B3.The use will not be in conflict with any provisions of the city code on an ongoing basis; The plan will be reviewed by our City Engineer and the applicant will be required to follow City requirements. The project will obtain approvals with outside agencies including MPCA, MCWD, and NPDES permitting. This criterion is met. B4.The use will not adversely affect the adjacent property, the surrounding neighborhood, or other uses on the property where the use will be located; The applicant shall ensure the project scope remains within the property lines, the haul route is monitored (and cleaned as often as necessary), and that any adverse impacts are mitigated. This criterion is met. B5.The use will not impose additional unreasonable costs on the public; The project will not impose additional costs on the public. This criterion is met. B6.The date or event that will terminate the use can be identified with certainty; The applicant has provided a project timeline which will commence in the Fall of 2024 and will be finalized in 2025. This criterion is met. B7.And the applicant agrees in writing to any conditions that the city council deems appropriate for the use, including a requirement for a financial security to ensure removal of all evidence of the use upon termination, and restoration of the site to prior or better conditions. The conditions shall be set forth in a development agreement between the property owner and the city, which agreement shall be recorded with the 2 O v CITY OF ORONO RESOLUTION OF THE CITY COUNCIL 7501 .kESH 6 � NO. 1111‘1L-e,4O� Hennepin County Recorder or Registrar of Deeds. Approval of the Interim Use Permit will be done through a resolution that is recorded against the property. All requirements and conditions will be listed as part of the resolution. This criterion is met. Additional Applicable Regulations (Section 78-916) B8. Consistent with the community management plan; The proposed activity on the property is consistent with the community management plan to allow the remediation of contaminated soils. B9. Compliant with the zoning code, including any conditions imposed on specific uses as required by article V, division 3 of the City Code; This criterion is met. B10.Adequately served by police, fire, roads, and stormwater management; This criterion is met. The applicant shall obtain all necessary permits. B11.Provided with an adequate water supply and sewage disposal system; This criterion is not applicable. B12. Not expected to generate excessive demand for public services at public cost; This criterion is met. B13.Compatible with the surrounding area as the area is used both presently and as it is planned to be used in the future; There is no change of use contemplated. The site currently has contaminated soils and the applicant will consolidate the contaminated soils into a berm and allow for clean soil on part of the site. Future development will need to meet any setback requirements from the berm or the removal of the contaminated soils. This criterion is met. B14. Consistent with the character of the surrounding area, unless a change of character is called for in the community management plan; The site currently is undeveloped and surrounded by highways and wetlands. Re-grading the site to allow for a berm on the south side of the property should not negatively impact neighboring parcels. The project will not result in a change in character. B15.Compatible with the character of buildings and site improvements in the surrounding area, unless a change of character is called for in the community management plan; The site will consolidate contaminated soil into a berm and have clean fill in a portion of the site. No development project is proposed as this time. The berm will be limited to a 25% slope to limit the height of the berm. Any excess contaminates will need to be hauled off site. The character of the site will be altered but is still in line with the community management plan. B16.Not expected to substantially impair the use and enjoyment of the property in the area or have a materially adverse impact on the property values in the area when compared to the impairment or impact of generally permitted uses; The proposed 3 lc° CITY OF ORONO RESOLUTION OF THE CITY COUNCIL G NO. 7501 -fk6S H oi" land alterations will be contained to the site and will meet all requirements by the City of Orono and other outside agencies. B17.Provided with screening and buffering adequate to mitigate undesirable views and activities likely to disturb surrounding uses; No screening or buffer requirements are required by the City. This criterion is met. B18. Not create a nuisance which generates smoke, noise, glare, vibration, odors, fumes, dust, electrical interference, general unsightliness, or other means; The proposed project will be contained to the site and is not permitted to encroach on neighboring properties. This criterion is met. B19. Not cause excessive non-residential traffic on residential streets, parking needs that cause a demonstrable inconvenience to adjoining properties, traffic congestion, or unsafe access; The access to the site is from Wayzata Boulevard,.a county road. No residential streets will be impacted by the project. This criterion is met. B20.Designed to take into account the natural, scenic, and historic features of the area and to minimize environmental impact; The applicant shall obtain approvals from outside agencies such as MCWD, MPCA, and NPDES permit. The project is proposed to move contaminated soil from one portion of the site to another; the materials will be properly capped and the berm/embankment will be created consistent with MPCA guidelines. This criterion is met. B21.All exterior lighting shall be so directed so as not to cast glare toward or onto the public right-of-way or neighboring residential uses or districts; This criterion is met; and B22.Not detrimental to the public health, public safety, or general welfare. This criterion is met. CONCLUSIONS, ORDER AND CONDITIONS: Based upon one or more of the above findings, the Orono City Council hereby grants an interim use permit pursuant with Orono Municipal Zoning Code Sections 78-916 and 78-1726 to allow approximately 9.86 acres of disturbance on the Property for consolidating contaminated soil and the creation of berm, subject to the following conditions: C1.Council approval is based on the entire record and the above Findings. C2.The approved project shall conform to the plan set Alliant submitted by the Applicants and annotated by City staff, attached to this Resolution as Exhibit B. C3.The Applicant agree to comply with MPCA standards for contaminated soil clean up including the design the berm approved and any future monitoring program. 4 OAT CITY OF ORONO RESOLUTION OF THE CITY COUNCIL A NO. 7501 G lRkESHOR� C4.Any amendments to the plans that are not in conformity with City codes may require further Planning Commission and City Council review. C5.The Applicants agree to comply with the permitting requirements of all applicable jurisdictions including the Minnehaha Creek Watershed District. C6.Authorities granted by this resolution run with the Property not with the Applicants, but are permissive only and must be exercised by commencing said project. The project must commence within one year of the date of Council approval, or the IUP will expire on that date (August 12, 2025). C7.Violation of or non-compliance with any of the terms and conditions of this resolution may result in the termination of any authority granted herein.
