�o� <br /> , o 0 <br /> CITY of ORONO <br /> � .� � <br /> ��� �G~ RESOLUTION OF THE CITY COUNCIL <br /> `��'EsKo�`' No. � � 0 6 <br /> A Resolution Amending the <br /> City of Orono Health Reimbursement Arrangement <br /> The undersigned, Linda S. Vee, serving as City Clerk of the City of Orono (the <br /> "Employer"), duly organized and existing under the laws of the State of Minnesota, does hereby <br /> certify that at a meeting of the City Council, held on the 13`� day of December, 2010, at which a <br /> quorum was present, the City Council unanimously adopted the following resolution: <br /> WHEREAS, the City of Orono previously adopted the Health Reimbursement <br /> Arrangement (the"Plan") on January l, 2006; and <br /> WHEREAS, the City previously amended the Plan effective January 1, 2009; and <br /> WHEREAS, the City of Orono desires to further amend and restate such Plan to include <br /> the following: <br /> • The Plan desires to amend and restate the Plan to incorporate all previous <br /> Summary of Material Modifications and to comply with the most recent and <br /> relevant regulatory changes since the last amendment and restatement of the <br /> Plan. <br /> NOW, THEREFORE, BE IT RESOLVED, that the City of Orono Health <br /> Reimbursement Arrangement be amended and restated effective as of January 1, 2011; and <br /> BE IT FURTHER RESOLVED, that any proper members of the City are hereby <br /> authorized to make such contributions from the funds of the City as are necessary to carry out the <br /> provisions of said plan at any time; and <br /> BE IT FiJRTHER RESOLVED,that in the event any conflict arises between the <br /> provisions of said Plan or any other applicable law or regulation (as such law or regulation may <br /> be interpreted or amended), the City shall resolve such conflict in a manner which complies with <br /> such law or regulation. <br /> ATTEST: <br /> ��a� .�r (/_.2�_ Q'u"e'r �' L�,��... <br /> Lmda S.
