The City of Orono received your building permit applications for new construction at 763
and 765 Boulder Drive on March 9, 2012. The permit application has expired due to lack
of required submittals. The building plans will be held until July 15, 2013 if you wish to
pick them up. After that date, the plans will be recycled.

Per Condition 6 of the Stonebay Planned Unit Development Agreement, "all residential buildings on the property
shall be constructed according to final plans which shall first be certified by the Planning Director as being in
conformity with the approved plans attached as Exhibit G to ensure compliance with the architectural
standards of the RPUD District. Final decisions by the Developer regarding colors, types and qualities of
building materials shall be subject to City staff approval to confirm their conformity with the approved
sample colors, types and qualities documented by reference in Exhibit G."
In reviewing Exhibit G and in comparison of your proposed plans for 763/765 Boulder Drive with the other rambler
townhomes already constructed in Stonebay, there are two items which appear to be not in conformity with the
approved plans:
1) Lack of a horizontal band in the siding that delineates floor levels; and
2) Lack of stone veneer wrapping along portions of the entry and garage areas.
Attached find annotated plans depicting the revisions needed. Please submit a revised plan set that includes these
missing features in order to comply with the expected level of architectural design established in the PUD Agreement.
I appreciate your efforts in working with the Homeowners Association and adjacent neighbor to resolve the driveway
location issue on these units.

S. Site Access. The only residentiat access to adjoinin; public streets shall be onto Kelley

approved site plan, Eshibit A. A right-in/right-out access from Willow Drive to Outlot
A may be used to access the parking area for the tennporary sales trailer until such tirne
that the trailer is moved onto the residential portion of the property. Future long-term
access to Outlot A from Willow Drive shall be determined at the time Outlflt A is
develaped. Future access to Outlot D shall be solely from Kelley Parkway. No direct
access from Outlots A and D sl�all be allowed to Highway 12. Internal circulation for the

Construction of all buildings shall be in conformance with the building codes and
regulations adopted by the City of Orono. Any substantiai changes to the gross square
footage, footprint/walUroof dimensions or defined building heights shall requi.re a prior
amendment to this Agreement. "Substantiai changes" shall include,but not be limited to,
(1) an increase in gross square footage or footprint/�valUroof dimensions of any unit so as
to require a replatting to keep the unit within its ownership L�t; (2) any increase in
building height foz rambler tor,vnhome units or trvo-story townhome units that would
result in the need for a variance to the standard 30' height limit; or (3) a one foot or
greater increase in height of the loft building above the 38' defined height approved per
Resolution No. 491 S.
The separation distances bet�veen townhome buildings shall be a minimum of 15' except
where specifically shown as less than l5' on the approved General Developrnent Plan.
Within each Phase of development, if any changes to pians zesult in building separations
Iess than 15', such plans shall be subject to prior review and approval by the City
Council.
