A RESOLUTION APPROVING
A SUBDIVISION OF A LOT LINE REARRANGEMENT
AT 2165 AND 2185 WATERTOWN ROAD
FILE NO. 15-3782
WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of Orono (hereinafter "City Council") has adopted
subdivision regulations for the orderly, economic and safe development of land within the City;
and
WHEREAS, Robert W. Kantor and Monique L. Kantor, a married couple
(hereinafter "the Kantors'), are owners of the property located at 2165 Watertown within the
City of Orono, and legally described as follows:
Attached as Exhibit A (hereinafter the "Kantor Property"); and
WHEREAS, Stephen H. Otto and Toshihim Ujiie, a married couple (hereinafter
"Otto & Ujiie"), are owners of the property located at 2185 Watertown Road within the City of
Orono, and legally described as follows:
Attached as Exhibit B (hereinafter the "Otto & Ujiie Property"; and
WHEREAS, the Kantors and Otto & Ujiie (hereinafter jointly the "Applicants")
have jointly made application to the City for approval of a lot line rearrangement which would
relocate the lot boundary line between the properties; and
WHEREAS, after due published and mailed notice in accordance with Minnesota
Statutes 462.358 et. seq. and the City of Orono Zoning and PIanning Codes, the Orono Planning
Commission held a public hearing on the proposed lot line rearrangement on September 21, 2015
at which time all persons desiring to be heard concerning this application were given the
opportunity to speak thereon, and on a vote of 6-0 recommended approval of the lot line
rearrangement; and

WHEREAS, the Orono City Council reviewed the proposed lot line
rearrangement at a regular meeting held on October 12, 2015 and makes the following findings
with regards to the proposed lot line rearrangement:
FINDINGS
1. This application was reviewed as Zoning File #15-3782.
2. The Kantor Property contains 3.27 acres in total area and currently contains a single
family residence.
3. The Otto & Ujiie Property contains 1.00 acres in total area and currently contains a single
family residence.
4. The properties are served by private wells and on-site sewage treatment systems.
5. This application contemplates a lot line rearrangement to relocate the common boundary
between the two properties such that the Kantor Property is reduced in total area to 2.57
acres and the Otto & Ujiie Property is increased in size to 1.70 acres.
6. The application also contemplates the creation of a new drainage and utility easement
located 5 feet on each side of the new property boundary.
7. As a result of the lot line rearrangement, the Kantor Property will continue to encompass
at least 2.00 acres in area net of wetlands and vehicular easements, will continue to have
two viable on-site sewage treatment sites, and will remain conforming to the RR -1B 2 -
acre minimum lot size requirement.
8. As a result of the lot line rearrangement, the Otto & Ujiie Property will gain in area to
contain 1.50 acres net of wetlands, and will become less non -conforming to the RR -1B 2 -
acre minimum lot size requirement.
9. Because this is a lot line rearrangement which results in no additional lots, no park fee or
stormwater trunk fee will be required.
CONCLUSIONS, ORDER AND CONDITIONS
NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the
findings noted above, the City Council of the City of Orono hereby grants the lot line
rearrangement of the above referenced properties based on the lot line rearrangement survey
dated August 28, 2015, by Mark Gronberg of Gronberg & Associates, Inc. attached as Exhibit
C, subject to the following conditions:

1. Following the lot line rearrangement the properties shall be legally described as shown in
Exhibit D attached.
2. The Applicants shall grant to the City drainage and utility easements 5 feet in width
either side of the new lot boundary for filing with Hennepin County.
3. The Applicants shall file the appropriate deeds reflecting the new legal descriptions
(subject to City Attorney approval) with the Hennepin County Recorder's Office and/or
Registrar of Titles Office on or before October 12, 2016, or the approval granted by this
resolution shall expire.
Adopted by the City Council of Orono, Minnesota this 12th day of October, 2015.
