HomeMy WebLinkAboutResolution 65450-14 C ITT OF SRONO RESOLUTION OF THE CITY COUNCIL NO. 650 A RESOLUTION APPROVING A SUBDIVISION OF A LOT LINE REARRANGEMENT AT 2251 PINE RIDGE LANE AND 2250 WAYZATA BOULEVARD FILE NO. 15-3758 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of Orono (hereinafter "City Council") has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, CLIFFORD L. OTTEN AND LOUISE W. OTTEN, husband and wife, (hereinafter the "Owners") are owners of the property located at 2251 Pine Ridge Lane within the City of Orono, Minnesota and legally described as follows: Lot 2, Block 2, EAST WILLOW WOODS, according to the recorded plat thereof, Hennepin County, Minnesota AND The South half of Pine Ridge Lane, as vacated per City of Orono Resolution No. 2803, Document No. 2132368, Hennepin County Records, subject to easements and restrictions of record, if any; (hereinafter the "Otten Parcel"); and WHEREAS, the City of Orono (hereinafter the "City") is owner of the property located at 2250 Wayzata Boulevard and legally described as follows: Outlot B, EAST WILLOW WOODS, Hennepin County, Minnesota (hereinafter "Outlot B"); and WHEREAS, the Owners and the City have agreed to conditions in which ownership of a portion of the Otten Parcel will be transferred to the City for use as a site for a municipal well, which requires approval of a lot line rearrangement to relocate the lot boundary line between the properties; and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono Planning Page 1 of 3 RESOLUTION OF THE CITY COUNCIL NO. 6545 Commission held a public hearing on the proposed lot line rearrangement on July 20, 2015 at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, the Orono City Council reviewed the proposed lot line rearrangement at a regular meeting held on August 10, 2015 and directed City staff to prepare a resolution for approval of the proposed lot line rearrangement; and WHEREAS, the Orono City Council makes the following findings with regards to the proposed lot line rearrangement: FINDINGS 1. This application was reviewed as Zoning File #15-3758. 2. The Often Parcel is zoned RR -1B One -Family Rural Residential District which requires 2.0 acres in area for a residential building site. 3. The Otten Parcel contains approximately 2.43 acres in total area and currently contains a single family residence structure. 4. The portion of the Otten Parcel to be transferred to the City (hereinafter the "Transferring Parcel") is approximately 0.81 acre in area, leaving the remaining portion of the Otten Parcel (hereinafter the "Remaining Otten Parcel") approximately 1.62 acres in area. 5. In order for the Remaining Otten Parcel to maintain a conforming lot area, the City Council has agreed to rezone the entire Otten Parcel to R-lA One -Family Residential District which requires 1.0 acres in area for a residential building site. 6. The City Council has agreed to provide the Remaining Otten Parcel with a connection to municipal sewer, and has agreed to grant a temporary easement over the Transferred Parcel for continued use of the existing septic system serving the residence at 2251 Pine Ridge Lane. 7. The City Council has agreed to provide the remaining Otten Parcel with an easement for driveway purposes over the Transferred Parcel to allow for continued access to Pine Ridge Lane Page 2 of 3 rl�Y OF � �RONTO RESOLUTION OF THE CITY COUNCIL NO. 6545 8. Following the lot line rearrangement the combined area of the Transferring Parcel and Outlot B will be approximatelyl.24 acres, sufficient to allow the development of and access to proposed Orono Municipal Well #4- 9. The lot line rearrangement upon rezoning as proposed will not result in the creation of any new nonconformities. 10. Because this is a lot line rearrangement which results in no additional lots, no park fee or stormwater trunk fee will be required. CONCLUSIONS, ORDER AND CONDITIONS NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the findings noted above, the City Council of the City of Orono hereby grants the lot line rearrangement of the above referenced properties based on the survey dated 06/18/2015 by Edward J. Rock III of Bolton & Menk, Inc., attached as Exhibit A; subject to the following conditions: 1. The Transferring Parcel shall be legally combined with Outlot B. 2. Following the lot line rearrangement the properties shall be legally described as follows: a. Remaining Otten Parcel: Description attached as Exhibit B; b. City Well Property: Description attached as Exhibit C. 3. The City shall file the appropriate deeds reflecting the new legal descriptions (subject to City Attorney approval) with the Hennepin County Recorder's Office and/or Registrar of Titles Office on or before September 28, 2016, or the approval granted by this resolution shall expire. Adopted by the City Council of Orono, Minnesota this 28th day of September, 2015.
