HomeMy WebLinkAboutResolution 6527RESOLUTION OF THE CITY COUNCIL NO. 6 52 7 A RESOLUTION GRANTING SETBACK VARIANCES FROM ORONO MUNICIPAL CODE SECTIONS 78-420 FILE NO. 15-3744 WHEREAS, J Brunello LLC, a Minnesota Limited Liability Company, (hereinafter the "Owner") is the owner of the property located at 190 Orono Orchard Road South within the City of Orono (hereinafter "City") and legally described as: Lot 48, Orono Orchards, according to the plat thereof, Hennepin County, Minnesota (hereinafter "the Property"); and WHEREAS, John Brunello, (hereinafter the "Applicant") on behalf of the Owner has made application to the City for a variance from Orono City Code Section 78-420 to permit construction of a new single family residence on the Property which has 1.5 acres (67,235 square feet) in area and 120 feet in width where 2.0 acres (87,120 square feet) in are and 200 feet of width is normally required; and WHEREAS, the Applicant has made application to the City for a variance from Orono City Code Section 78-420 to permit construction of a new single family residence on the Property 30.5 feet from the south side street property line where a 50 foot setback is required; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public hearing on June 15, 2015, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: I. This application was reviewed as Zoning File #15-3744. 2. The Property is located in the RR -1 B One Family Lakeshore Residential Zoning District which requires a minimum lot area of 2.0 acres and a minimum lot width of 200'. 3. The Planning Commission reviewed this application on June 15, 2015, the Planning Commission voted 6 in favor and 0 opposed on a motion in favor of approval of the side street setback, lot area and lot width variances; based on the following findings: Page 1 of 4 CITY OF 0 l-Ot-40 RESOLUTION OF THE CITY COUNCIL NO. 6 577 a). The Property contains 67,235 square feet in area (1.5 acres) and has 120 feet in width. b). The variance to allow construction of the new residence on the Property which is substandard with respect to area and width will alleviate a practical difficulty inherent to the Property and was not created by the Applicant. c). The Applicant's proposal results in 3,585 square feet of structural coverage or 5.3% where 15% is permitted. d). The proposed side street setback at 30.5 feet will not be out of character with the neighborhood. All other setbacks will be met. e). The variance to construct a new residence on the Property is in harmony with the general intent and purpose of the Ordinance. f). The variance to permit construction of a new residence in the proposed location in a residential district is consistent with the comprehensive plan. g). The Applicant has provided a survey reflecting the limited building envelope on the substandard lot area and width Property establishing that there are practical difficulties. h). The Applicant proposes to use the property in a reasonable manner not permitted by the official controls. i). The circumstances unique to the Property were not created by the landowner. j). Construction of a new residence is limited by the proximity to wetland soils, topography and substandard width. The proposed project will be consistent with the neighborhood, and will not adversely impact adjacent properties. k). The granting of the proposed variances will not in any way impair health, safety, comfort or morals, or in any other respect be contrary to the intent of this chapter. 1). The granting of the requested variances will not merely serve as a convenience to the Applicant, but is necessary to alleviate demonstrable difficulty. 4. The City Council considered this application at a meeting held on July 27, 2015 including the findings and recommendations of the Planning Commission, reports by Page 2 of 4 CITY OF UR,01,%,10 RESOLUTION OF THE CITY COUNCIL No_ 6 5 2 l City staff, comments by the Applicant and the public, and the effect of the proposed variances on the health, safety and welfare of the community as well as the impact on properties in the vicinity. 5. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Owners, but is necessary to alleviate a practical difficulty; is necessary to preserve a substantial property right of the Applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based on the above findings, City Council of Orono, Minnesota hereby grants a variance from Orono City Code Section 78-420 to permit construction of a new single family residence on the Property which has 1.5 acres (67,235 square feet) in area and 120 feet in width where 2.0 acres (87,120 square feet) in area and 200 feet of width is normally required; and a variance from Orono City Code Section 78-420 to permit construction of a new single family residence on the Property 30.5 feet from the south side street property line where a 50 foot setback is required,subject to the following conditions: 1. Council approval is based on the survey, landscape and building plans submitted by the Applicant and annotated by City staff, attached to this Resolution as Exhibits A, B & C. Any amendments to these plans may require further Planning Commission and City Council review. 2. Authorities granted by this resolution run with the Property not with the Applicant, but are permissive only and must be exercised by obtaining a building permit for the new construction and commencing construction of said project. A framing inspection must be completed within one year of the date of Council approval, or the variances will expire on that date (July 27, 2016). 3. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned Applicant has read, understands and hereby agrees to the terms of this resolution and on behalf of their heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the Property.
