HomeMy WebLinkAboutResolution 6517CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO 6 51 ", A RESOLUTION APPROVING THE PLAT OF LAKEVIEW FILE #15-3723 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has adopted subdivision and land development regulations for the orderly, economic and safe development of land within the City; and WHEREAS, on August 20, 2014 Source Land Capital, LLC (hereinafter the "Developer") submitted an application for approval of a Preliminary Plat and Planned Residential Development for property located at 405 North Arm Drive in the City of Orono and legally described in Exhibit A (attached); and WHEREAS, the Orono PIanning Commission held a public hearings on the proposed subdivision on September 15, 2014 and again on October 20, 2014 and voted 7 in favor, 0 against to recommend approval of the Preliminary Plat and PRD zoning; and WHEREAS, the Orono City Council reviewed the application at meetings on October 27, 2014 and November 24, 2014, and on December 8, 2014 granted approval for Preliminary Plat and Planned Residential Development Overlay per the findings and conditions of Resolution No. 6474; and WHEREAS, the Developer has agreed to comply with all conditions of Resolution No. 6474 and has completed or has agreed to complete all other requirements of the platting regulations of the City including: 1. Completion of all platting requirements and conditions of Preliminary Plat Resolution No. 6474. 2. Dedication on the plat of perimeter Drainage and Utility Easements as required in Resolution No. 6474. Page 1 of 5 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 6517 3. Designation and dedication on the plat of wetlands subject to City and other agency jurisdiction, and execution of a Permanent Wetland Conservation and Flowage Easement and Restrictive Covenants for protection of wetlands, and establishment of wetland buffers and buffer maintenance provisions per the requirements of the Minnehaha Creek Watershed District (MCWD). 4. Execution of a Road, Drainage and Utility Easement to the City of Orono over the private road Outlots, and execution of a "Declaration of Covenants, Conditions, Restrictions and Private Roadway Easement" with regard to the private roads. 5. Execution of a Conservation Easement over the areas designated for preservation and management as permanent open space. 6. Execution of a Declaration of Covenants, Conditions, Easements and Restrictions for Stormwater Management facilities including establishment of pond infiltration basin maintenance obligations. 7. Submittal of Minnehaha Creek Watershed District (MCWD) permit approving the grading and stormwater management facilities plan for the development of the Property as proposed per the approved Grading and SWPP Plans as noted herein. 8. Provision to the City of a title opinion for the Property and certified copies of all recorded easements currently affecting the Property. 9. Execution of a Development Contract and Planned Residential Development Agreement including provision of financial security including a Letter of Credit and escrow to ensure that all site improvements are installed and maintained to the City's specifications and satisfaction, and to establish conditions for fixture development of the site. 10. Payment of development fees as established in Resolution No. 6474 or as follows: a. Park Dedication Fee: $255,300.00 b. Stormwater and Drainage Trunk Fee: $195,010.00 NOW, THEREFORE, BE IT RESOLVED that based on the findings of Resolution No. 6474, the City Council of the City of Orono does hereby approve the plat of LAKEVIEW, Hennepin County, Minnesota (a copy of which is attached as Exhibit B) subject to the following conditions: Page 2 of 5 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 6517 Development within LAKEVIEW is subject to the Conclusions, Orders and Conditions enumerated within Preliminary Plat Resolution No 6474, and subject to the provisions of the Development Contract and Planned Residential Development Agreement for LAKEVIEW slated _ , 2015. 2. The approvals granted in this Resolution shall become effective only when all conditions of approval requiring actions by the Developer have been satisfied. 3. The City Clerk shall release the plat documents for filing only upon certification by the City Attorney, Senior Planner and City Engineer that all requirements of the platting regulations have been satisfied. 4. The aforesaid plat shall be filed by the City of Orono with Hennepin County on or before December 22, 2015 together with a certified original copy of this resolution and executed copies of the easements and covenants pertinent thereto. The approval granted by this Resolution shall expire if the conditions of this Resolution have not been met or the plat has not been filed by the date specified above. In that event, it will be necessary to file a new application with the City of Orono for subdivision review. Adopted by the City Council of Orono this 22nd day of June, 2015. The West and North boundary lines of which tract are particularly described as follows: Beginning at the Southwest corner of the Northwest Quarter of the Northeast Quarter of said Section 7, indicated by a concrete monument bearing a brass plate marked "Judicial Landmark:" located at said point; thence North along the West line of the Northeast Quarter of said Section 7, a distance of 1312 and 151100 feet to the point of intersection of said line with the North line of said Section 7, indicated by a Sandstone monument located at said point; thence East along the North line of said Section 7, a distance of 2008 and 5110 feet to the intersection of said line with the North Arm of Lake Minnetonka, indicated by a concrete monument with a brass plate marked "Judicial Landmark" Iocated at said point. That part of the West 10 acres of the Northeast Quarter of the Southwest Quarter of Section 6, Township 117, Range`23, lying Southwesterly of the centerline of North Arm Drive, formerly County Road No. 43; The South Half of the North Half of the Southwest Quarter of the Southwest Quarter of Section 6, Township 117,Range 23, EXCEPT the North 178.45 feet of the West 500 feet thereof; The North 261 feet of the Southeast Quarter of the Southwest Quarter of the Southwest Quarter of Section 6, Township 117, Range 23, Hennepin County, Minnesota. The East 200 feet of the West 400 feet of the South 203 feet of the Southeast Quarter of the Southwest Quarter of Section 6, Township 117, Range 23, Hennepin County, Minnesota, according to the United States Government Survey thereof. Par. 1: The Southeast Quarter of the Southwest Quarter, except the West 400 feet of the South 203 feet thereof and except the East 150 feet of the West 550 feet of the South 303 feet thereof, and except that part of the North 52 feet of the South 355 feet of said Southeast Quarter of the Southwest Quarter which lies between lines bearing North 41 degrees 07 minutes 37 seconds East from the Northwest and Northeast corners of said East 150 feet assuming the west line of said East 150 feet bears North 0 degrees 04 minutes 25 seconds West.
