K `w A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR WINTER TRAINING FACILITY BUILDING PURSUANT TO ORONO MUNICIPAL CODE SECTION 78-418 FILE NO. 15-3729 WHEREAS, Spring Hill Golf Club, a Minnesota nonprofit corporation (hereinafter the "Owner") is the owner of the property located at 725 Sixth Avenue North within the City of Orono (hereinafter "City") and legally described as: Lot 1, Block 2, Spring Hill Golf Club, Hennepin County, Minnesota (hereinafter "the Property"); and WHEREAS, Tim Johnson (hereinafter the "Applicant") on behalf of the Owner has made an application to the City pursuant to Orono Municipal Code Section 78-418 for a conditional use permit (hereinafter the "CUP") to permit construction of a winter training facility building (hereinafter the "Building"), a new driveway and parking area; WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public hearing on April 20, 2015 at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. Minnesota: NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, FINDINGS 1. This application was reviewed as Zoning File 15-3729. 2. The Property is located in the RR -1 B One Family Rural Residential Zoning District which requires a minimum lot area of 2.0 acres and a minimum lot width of 200`. 3. The Spring Hill Golf Club operates pursuant to Conditional Use Permits approved by the City in 1997. 4. The Planning Commission reviewed this application at a public hearing held on April 20, 2015 and recommended conditional approval of the CUP based on the following findings: Page 1 of 4 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO 6 50 1 a. The Spring Hill Golf Club property in total contains 203.45 acres; 155.25 acres within Orono and 48.2 acres within Medina. b. The application was reviewed based on the following plans by James R. Hill (hereinafter collectively the "Plans"): i. Sheet 1.2 Drainage Maps dated 03/18/15 ii. Sheet 2.1 Erosion & Sediment Control Details dated 05/05/15 iii. Sheet 3.1 Final Grading & Drainage Plan dated 04/30/15 iv. Sheet 4.1 Final Utility & Site Plan dated 05/05/15 v. Sheet 4.2 Preliminary Landscape Plan dated 05/05/15 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, comments by the Applicant, and comments from the public, as well as the effect of the proposed conditional use on the health, safety and welfare of the community as well as the impact on properties in the vicinity. 6. The City Council finds that the project is in accord with the objectives of the RR - 1 B zoning district in which the Property is located and with the comprehensive municipal plan and that the Building will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a approval pursuant to Orono Municipal Zoning Code Section 78418 for a conditional use permit (hereinafter the "CUP") to permit construction of the Building, a new driveway and parking area, subject to the following conditions: Council approval is based on the Plans submitted by the Applicant and annotated by City staff, attached to this Resolution as Exhibits A through E; and the submitted elevation drawings and floor plan attached as Exhibits F & G. Any amendments to the Plans which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Owner shall maintain the septic system under a contract with a licensed pumper and annual pumping reports shall be submitted to the City. 3. All necessary permits by the Minnehaha Creek Watershed District shall be obtained. Page 2 of 4 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 650? 4. All exterior lighting shall be approved by the City and will be held to Dark Sky lighting standards. 5. All necessary City construction permits must be obtained prior to the commencement of construction. 6. Authorities granted by this resolution run with the Property not with the Owner, but are permissive only and must be exercised by obtaining a building permit for the project and completing a footing inspection within one year of the date of the Council approval or the CUP will expire on that date (May 11, 2016). 7 Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. The undersigned Owner has read, understands and hereby agrees to the terms of this resolution and on behalf of the Owner and the Owner's heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the Property.
