A RESOLUTION APPROVING
AMENDMENT #1 OF THE
2008-2030 CITY OF ORONO
COMMUNITY MANAGEMENT PLAN
WHEREAS, the City of Orono is a municipal corporation located within
Hennepin County and within the planning jurisdiction of the Metropolitan Council; and
WHEREAS, in accordance with the Metropolitan Land Planning Act of 1976 and
its amendments, and with Minnesota Statutes Chapters 462 and 473, the City of Orono in
September 2010 adopted a comprehensive municipal plan known as the 2008-2030 City of
Orono Community Management Plan(also referred to as the 2008-2030 CMP) to provide for the
orderly development of the City; and
WHEREAS, an integral element of the 2008-2030 CMP is the Comprehensive
Sewer Policy Plan, which identifies certain areas of the City as being within the Metropolitan
Urban Service Area(MUSA) in which connections to the metropolitan sanitary sewer system are
allowed; and
WHEREAS, the property at 20 Orono Orchard Road North within the City of
Orono contains a single family residence structure constructed in the 1950s or earlier and is
approximately 2.0 acres in area, of which approximately 1.25 acres is wetland. The property is
zoned RR-1B Rural Residential, 2-acre minimum lot size and currently has a failing non-
conforming septic s3�stem; and
WHEREAS, the property is located along Orono Orchard Road approximately
700 feet from the existing Orono municipal sewer system that serves the Orono Orchards
neighborhood. The property is not currently within the Metropolitan Urban Service Area
(MtTSA), but is directly across the Luce Line Trail from the Orono Orchards neighborhood
which is within the MUSA; and
WHEREAS, the property does not have available area for septic system
replacement or expansion; and
WHEREAS, the property owner has formally requested that the property be
incorporated into the ML1SA to allow for future connection to the municipal sewer system; and

WHEREAS, Metropolitan Council staff have advised the City that this property
can be added to the MUSA through a minor amendment to the CMP. The amendment is exempt
from the 60-day comment period by adjacent jurisdictions because it is less than 40 acres in area,
it does not change any Metropolitan Growth Forecasts, and is further from adjacent jurisdictions
than the City's standard notification distance; and
WHEREAS, the property does meet the exceptions established by Metropolitan
Council so that the property will not be counted against Orono's density calculations, because it
was 1) developed prior to 1985; 2) has a failing septic system; and 3) there are no alternative
locations on the property where a replacement septic system would be feasible; and
WHEREAS, in light of the above noted facts the Orono Planning Commission
pursuant to published and written notice held a public hearing on July 16, 2012 and on a vote of
6-0 recommended that the property at ?0 Orono Orchard Road South be added to the MUSA.
WHEREAS, the Orono City Council on July 23, 2012 voted 5-0 to conditionally
approve an amendment of the 2008-2030 Community Management Plan (CMP) to include 20
Orono Orchard Road North in the Metropolitan Urban Service Area subject to Metropolitan
Council review and approval, and directed City staff to prepare such an amendment and submit it
to the Metropolitan Council for review and approval; and
WHEREAS, on July 26, 2012 documentation for the proposed amendment was
submitted to the Metropolitan Council for review and approval; and
WHEREAS, on August 13, 2012 the Metropolitan Council indicated to the City
via letter that the 2008-2030 CMP Amendment to include 20 Orono Orchard Road North within
the MUSA meets the Comprehensive Plan Amendment Administrative Review Guidelines
adopted by Met Council on July 28, 2010. The proposed amendment does not affect official
forecasts, or the City's ability to accommodate its share of the region's affordable housing need.
Therefore, Met Council will waive further review and action, and the City may place this
amendment into effect.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Orono hereby amends the 2008-2030 City of Orono Community Management Plan Part 4C,
Comprehensive Sewer Policy Plan (CSPP) by incorporating into the MUSA the property at 20
Orono Orchard Road North described in attached Exhibit A, finding that:
1. The amendment meets the intent of the basic goals, objectives and policies set forth in the

-2030 CMP.
2. The amendment is consistent with the goals, objectives, needs and desires of Orono
residents.
3. The amendment is consistent with the planning goals and objectives of Orono's
municipal neighbors.
FURTHER BE IT RESOLVED that Maps 4C-2 and 4C-2 Supplement shall be
revised to reflect the property at 20 Orono Orchard Road North as Part XX��I (Part 51) of the
Orono MUSA.
