� o� <br /> O , O CITY of ORONO <br /> ;az,= <br /> � `� °:�;,. � RESOLUTION OF THE CITY COUNCIL <br /> �� � ��F N o. 6 1 � 8 <br /> �kESH�g'� <br /> A RESOLUTION <br /> GRANTING A VARIANCE TO ORONO MUNICIPAL CODE <br /> SECTION 78-395 <br /> FILE NO. 12-3578 <br /> WHEREAS, Dennis M. Krump and Deborah Krump, a married couple, <br /> (hereinafter "Applicants") are the owners of the property located at 25 Stubbs Bay Road <br /> North within the City of Orono (hereinafter "City") and legally described as: Attached as <br /> "Exhibit A", (hereinafter"the Property"); and <br /> WHEREAS, the Applicants have made application to the City for a variance <br /> from Orono Code Section 78-395(b) in order to construct an attached garage 29.2 feet from <br /> the north, side lot line where a 50 foot setback is required; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission <br /> held a public hearing on October 15, 2012, at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #12-3578. <br /> 2. The Property is located in the RR-1A zoning district, where 5.0 acres is the <br /> minimum lot area and 300 feet is the minimum defined lot width. The Property <br /> is approximately 1.22 acre in area and has 123 feet in width. <br /> 3. The Planning Commission reviewed this application on October 15, 2012 and <br /> on a vote of 7 - 0 recommended approval of the variance, based on the <br /> following findings: <br /> a. There is no additional property available for the Applicants to purchase <br /> to make the Property conforming with respect to width. <br /> b. The location of the existing home and the width of the property makes <br /> it difficult to construct a functional, conforming garage addition <br /> elsewhere on the Property. <br /> Page 1 of 4 <br />
