A RESOLUTION
GRANTING A SIX-MONTH EXTENSION
TO THE EFFECTIVE PERIOD OF SUBDIVISION APPROVAL
ESTABLISHED PER RESOLUTION NO. 6136

WHEREAS, on April 23, 2012, the City Council of the City of Orono (the "City")
adopted Resolution No. 6136 granting final subdivision approval for a Class I subdivision of
property located at 4550 Wolverton Place and legally described as Lot 1, Block 1, FOXFYRE
ESTATES, Hennepin County, Minnesota; and
WHEREAS, City of Orono Municipal Code Section 82-146 establishes that final
plat approval is effective for six months from the date of such approval, and failure to complete the
requirements for recording the subdivision within this time period shall be considered as formal
withdrawal of the proposed subdivision; and
WHEREAS, Class I subdivision approval is similar in effect to a final plat approval;
the effective period of subdivision approval extends for six months from the date of Council
approval; and
WHEREAS, subdivision approval runs with the land, not the applicant; and
WHEREAS, due to market conditions and other reasons, the applicant would like
to temporarily postpone requesting completing and recording the subdivision. Therefore, the
applicant has requested a six month extension of the effective period of subdivision approval
granted in Resolution No. 6136; and
WHEREAS, the applicant has requested a six month extension of the effective
period of subdivision approval to April 23, 2013.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orono,
Minnesota, as follows:
1. The effective period of subdivision approval is hereby extended to April 23, 2013; and
2. All other terms and conditions of Resolution No. 6136 are hereby reaffirmed.
