� o� <br /> O �a O CITY of ORONO <br /> �; <br /> � � , �' � RESOLUTION OF THE CITY COUNCIL <br /> �'� ` :��° �; ��F No. 6 1 T 6 <br /> L�k'ESHOg'� <br /> A RESOLUTION <br /> GRANTING A SIX-MONTH EXTENSION <br /> TO THE EFFECTIVE PERIOD OF SUBDIVISION APPROVAL <br /> ESTABLISHED PER RESOLUTION NO. 6136 <br /> File No. 11-3531 <br /> WHEREAS, on April 23, 2012, the City Council of the City of Orono (the "City") <br /> adopted Resolution No. 6136 granting final subdivision approval for a Class I subdivision of <br /> property located at 4550 Wolverton Place and legally described as Lot 1, Block 1, FOXFYRE <br /> ESTATES, Hennepin County, Minnesota; and <br /> WHEREAS, City of Orono Municipal Code Section 82-146 establishes that final <br /> plat approval is effective for six months from the date of such approval, and failure to complete the <br /> requirements for recording the subdivision within this time period shall be considered as formal <br /> withdrawal of the proposed subdivision; and <br /> WHEREAS, Class I subdivision approval is similar in effect to a final plat approval; <br /> the effective period of subdivision approval extends for six months from the date of Council <br /> approval; and <br /> WHEREAS, subdivision approval runs with the land, not the applicant; and <br /> WHEREAS, due to market conditions and other reasons, the applicant would like <br /> to temporarily postpone requesting completing and recording the subdivision. Therefore, the <br /> applicant has requested a six month extension of the effective period of subdivision approval <br /> granted in Resolution No. 6136; and <br /> WHEREAS, the applicant has requested a six month extension of the effective <br /> period of subdivision approval to April 23, 2013. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orono, <br /> Minnesota, as follows: <br /> 1. The effective period of subdivision approval is hereby extended to April 23, 2013; and <br /> 2. All other terms and conditions of Resolution No. 6136 are hereby reaffirmed. <br /> Page 1 of 2 <br />
