Box 66 Crystal Bay, MN 55323 Dear Ms. Mabusth: Our client is considering purchasing a residential building site on the west side of Brown Road immediately adjacent to the south right-of-way line of the Luce Line Trail. Long Lake Creek runs through the property. A major portion of the property is designated wetland. The various setback requirements reduce the buildable area to a relatively small portion of the site. Before finalizing the purchase of the property our client wants to determine the soil conditions in the location of the proposed house and the existence of areas large enough for septic treatment within the boundaries determined by setback requirements. It is my understanding that the foundation line of the house must be a least 50'-0 ’ from the front property line, 30*-0'' from side property lines, lOO’-O* from the creek and 26’-0* from wetlands and that roof overhangs can extend a maximum of r-6 ’ into the setback areas. Also, I understand, that the septic treatment area must be at least 20’-0* from property lines, 75 ’-0* from wetlands, 75 ’-0* from the creek and 20’-0* from the foundation line of a b' ilding. The enclosed site plan drawing dated 18 January 1994 was prepared to illustrate the setback requirements for a structure and septic treatment areas on this particular site. The Hennepin County Highway Department has indicated that the location of driveway access to the site is acceptable at the approximate location shouu on the drawing. The house has not been designed. Its size and plan configuration will change as the scheme is developed. The location and configuration of the driveway will probably change with the design of the house. We are seeking confirmation from you that our understanding of the setback requirements for this site is correct. Also, we would appreciate information from you about other regulations, that you are aware of, that would affect the p!2cer.ic.:t of the house, driveway or septic treatment areas. 1 will call you in a few days and I am available, at your convenience, to come to your office to discuss the site plan in detail if you wish.
