A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTIONS 78-330 and 78-1288 FILE NO. 12-3565 WHEREAS, Gail M. Teynor & Joseph T. Teynor, a married couple (hereinafter "the Applicants") are the owners of the property located at 2789 Pheasant Road within the City of Orono (hereinafter the "City") and legally described as: Tract A, RLS No. 310, Hennepin County, Minnesota (hereinafter the "Proper+�•"�; and t WHEREAS, +" ���`�� e made application to the City of Orono for a variance to Orono ^" � � �. �ction 78-330 to allow construction of a new residence on an e �. �� (� `he OHWL and 100 feet in width at the 75-foot setback where 140 � �, Sb�,�s(�y� normally required; and � . `� C�e>' 1 WHE1 �5���( Y�� ade application to the City of Orono for a variance to Orono M�, `�V "' � - ,8-1288 to allow 6,740 square feet or 38.5% hardcover within the ., 15% is normally allowed in conjunction with the construction of a new re .,� WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public hearing on July 16, 2012 at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File 12-3565. 2. The Property is located in the LR-1 B One Family Lakeshore Residential Zoning District which requires a minimum lot area of 1.0 acres and a minimum lot width of 140'. 3. The Planning Commission reviewed this application at a public hearing held on July 16, 2012 and recommended approval of the lot width variance and denial of the hardcover variance based on the following findings: Page 1 of 5 � o� O , O CITY of ORONO � _ - +-� � �'. � RESOLUTION OF THE CITY COUNCIL �'� .h�� .. The Property has 46,000 square feet (1.05 acre) in area and 100 feet in width at the OHWL and 100 feet in width at the 75-foot setback where 43,560 square feet (1.0 acre) in area and 140-feet in width are normally required. b. Sanitary sewer and City water are available. c. There is no additional land available to bring the lot width into conformity. d. The Planning Commission finds that a residential structure can be built on the Property without the need for a hardcover variance. 4. The City Council finds that the following factors support the granting of a hardcover variance: a. The Applicants' proposal results in an overall total reduction in hardcover from the current levels by over 2,000 square feet within the 75' to 250' zone; and by 7,040 square feet within the 250' to 500' zone on the property. b. The Applicants' plan results in 22.4% overall hardcover for the entire site. c. The Applicants' request will alleviate a practical difficulty inherent to the Property and not created by the Applicants. d. The Applicants' request will not alter the essential character of the neighborhood and will result in minimal negative impact on adjacent properties. e. The Applicants' request is in harmony with the purpose and intent of the ordinance. f. The Applicants have demonstrated that enforcing the 75' to 250' zone hardcover and lot width provisions of the Zoning Ordinance deprive the Applicants of the reasonable use of their Property. 5. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 6. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other property in this zoning district; that granting Page2of5 � O� O a_ O CITY of ORONO ���z,_ � �' �► RESOLUTION OF THE CITY COUNCIL '� ::�z :; � �,�� No. 6762 L�kESH�g'� the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Applicants, but is necessary to alleviate a practical difficulty; is necessary to preserve a substantial property right of the Applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance from Orono Municipal Zoning Code Section 78-330 to allow construction of a new residence on an existing lot with 100 feet in width at the OHWL and 100 feet in width at the 75- foot setback where 140-feet in width at both setbacks is normally required; and a variance from Orono Municipal Zoning Code Section 78-1288 to allow 6,740 square feet or 38.5% hardcover within the 75'-250' zone where 25% is normally allowed in conjunction with the construction of a new residence, subject to the following conditions: 1. Council approval is based on the survey and building plans submitted by the Applicants and annotated by City staff, attached to this Resolution as Exhibits A and B. Any amendments to the plans which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Hardcover shall not increase above the approved levels as follows: 1.7% hardcover within the 0-75' zone for an existing boat house; 6,740 square feet (38.5%) of hardcover within the 75' to 250' zone; and 3,460 square feet (16.5%) hardcover within the 250' to 500' zone. 3. The Applicants' building permit survey and plans shall address the city engineer's comments and recommendations. 4. The home plans submitted are for the purpose of hardcover review. The construction plans and survey submitted for building permit will be reviewed for conformance with Orono's building height and number of stories calculation. 5. Authorities granted by this resolution run with the Property not with the Applicants, but are permissive only and must be exercised by obtaining a building permit for the new construction and commencing construction of said project. A framing inspection must be completed within one year of the date of Council approval, or the variance will expire on that date (August 27, 2013). Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. The undersigned Applicants have read, understand and hereby agree to the terms of this resolution and on behalf of the Applicants and the Applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the Property.
