Judd Suite 550 Shelard Tower 600 South Highway 18 Minneapolis, MN 55426-1203 Dear Mr. Judd: Thank you for your letter of January 17th reviewing your clients' proposed use of the property identified as record Lot 19. The total area of the jointly owned 11 parcels is approximately 1.7 acres. Our records reveal that the original owner Mick Lord has neither executed special combination papers nor the procedural lot area variance resolution for filing against the subject property. I would be happy to meet with you to discuss the necessary applications, fees and schedule of meetings. Before I schedule such a meeting, I must seek the opinion of the City Attorney concerning the issue of the need for an area variance for your clients' proposed day use recreation area. Sect!' . 10.31, Subdivision 6 (F) Substandard - Buildable Record Lot Inventory lists the only permitted use for substandard Lot 19 as one-family seasonal recreational use or for a single permitted seasonal dwelling. Section 10.31, Subdivision 3 (C) requires a minimum of five_acres for day use_recrea t i on areas. The code goes on to further state that if the number of users exceeds 100, the minimum lot area must be increased to maintain ratio of 1 acre per 20 users. Section 10.31, Subdivision 6 (E) Conforming Record Lot Inventory lists seven properties permitted only one-family permitted or conditional uses in the RS District. In consideration of the text and the purpose (Section 1C.31, Subdivision 1) of the RS District code, the City may not be allowed to consider such a variance.
