. <br /> , • <br /> � O� <br /> O , O CITY of ORONO <br /> � - <br /> a.. <br /> � � ,� � �+ RESOLUTION OF THE CITY COUNCIL <br /> �� �G�� N o. 6 1 5 7 <br /> �kESH�g' <br /> A RESOLUTION <br /> GRANTING PRELIMINARY APPROVAL OF <br /> AMENDMENT #1 OF THE <br /> ORONO 2008-2030 COMMUNITY MANAGEMENT PLAN: <br /> 20 ORONO ORCHARD ROAD NORTH -MUSA <br /> FILE NO. 12-3566 <br /> WHEREAS, the City of Orono (hereinafter "City") is a municipal corporation <br /> organized and existing under the laws of the State of Minnesota; and <br /> WHEREAS, in September 2010 the Orono City Council adopted the 2008-2030 <br /> Orono Community Management Plan (hereinafter "CMP" or "the Comprehensive Plan") to <br /> provide for the orderly development of the City, in compliance with the Metropolitan Land <br /> Planning Act of 1976 and Minnesota Statutes Chapters 462 and 473; and <br /> WHEREAS, an integral element of the 2008-2030 CMP is the Comprehensive <br /> Sewer Policy Plan, which identifies certain areas of the City as being within the Metropolitan <br /> Urban Service Area (MUSA) in which connections to the metropolitan sanitary sewer system are <br /> allowed; and <br /> WHEREAS, the property at 20 Orono Orchard Road North within the City of <br /> Orono contains a single family residence structure constructed in the 1950s or earlier and is <br /> approximately 2.0 acres in area, of which approximately 1.25 acres is wetland. The property is <br /> zoned RR-1B Rural Residential, 2-acre minimum lot size and currently has a failing non- <br /> conforming septic system; and <br /> WHEREAS, the property is located along Orono Orchard Road approximately <br /> 700 feet from the existing Orono municipal sewer system that serves the Orono Orchards <br /> neighborhood. The property is not currently within the Metropolitan Urban Service Area <br /> (MUSA), but is directly across the Luce Line Trail from the Orono Orchards neighborhood <br /> which is within the MUSA; and <br /> WHEREAS, the property does not have available area for septic system <br /> replacement or expansion; and <br /> WHEREAS, the property owner has formally requested that the property be <br /> incorporated into the MUSA to allow for future connection to the municipal sewer system; and <br /> Page 1 of 2 <br />
