HomeMy WebLinkAboutResolution 6136 � o� O � O CITY of ORONO >�� _� � ��`'� �+ RESOLUTION OF THE CITY COUNCIL �,� �, :��G`� G�ti No. 6 1 ;iL� ��kESH�g'� A RESOLUTION APPROVING A CLASS I SUBDIVISION OF PROPERTY LOCATED AT 4550 WOLVERTON PLACE FILE #11-3531 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has adopted subdivision and land development regulations for the orderly, economic and safe development of land within the City; and WHEREAS, on April 23, 2012 the City Council considered the application by Lori Gherardi on behalf of Wolverton Place, LLC (hereinafter the "Developer") for subdivision of property located at 4550 Wolverton Place and legally described as Lot l, Block 1, FOXFYRE ESTATES, Hennepin County, Minnesota(hereinafter "the Property"); and WHEREAS, the proposed subdivision consists of a lot split of the 10.1 acre Property to result in two 5-acre residential tracts for single family residential purposes; and WHEREAS, the proposed subdivision results in two tracts, one for the existing residence and one new building site, each of which meets the area and width standards for the RR-lA district in which the Property is located.No road or utility improvements are required. The tracts will be served by wells and septic systems; septic drainfield sites have been tested and approved. Both tracts will have driveways accessing the existing private road known as Wolverton Place; and WHEREAS, as a result of the Conservation Design review process, specific natural features of the Property are intended to be preserved and enhanced,subject to establishment of wetland,tree stand and grassland protective easements; and WHEREAS, because the City of Orono Comprehensive Trail System Plan includes a future trail along McCulley Road. a 10' trail easement along the northwesterly Property line abutting McCulley Road is being granted; and Page 1 of 4 � � o� O � O CITY of ORONO ��� _ �:_ � � ',,�4 � RESOLUTION OF THE CITY COUNCIL �� � �;� .:�° � titi No. 6 1 3 6 G �`�k'ESHog'� WHEREAS, the Developer has completed or has agreed to complete all other requirements of the subdivision regulations of the City including: 1. Completion of the requirements for Class I subdivision approval as enumerated in Municipal Code Chapter 82. 2. Granting of Permanent Easement for Public Drainage and Utility Purposes located 5' either side of the new lot line. 3. Granting of Permanent Flowage and Conservation Easement and Restrictive Covenant for Wetland and Wetland Buffer in relation to wetlands on the Property. 4. Granting of Permanent Easement for Public Trail Purposes along the northwesterly 10 feet of the Property abutting McCulley Road. 5. Granting of Permanent Tree Stand and Native Grassland Preservation and Conservation Easement in relation to existing trees and grasslands on the Property. 6. Establishment of Restrictive Covenants for Protection of Sewage Treatment Sites. 7. Payment of Park Dedication Fee for Proposed Tract A in the amount of$5,550.00. 8. Payment of Storm Water and Drainage Trunk Fee for the property in the amount of $13,433.00. 9. Establishment of Escrow for invasive species removal,tree mitigation, tree protection and wetland protection and mitigation, in the amount of$18,000.00. 10. Provision to the City of a title opinion for the Property and certified copies of all recorded easements currently affecting the Property. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Orono does hereby approve the subdivision of Lot 1, Block 1, FOXFYRE ESTATES, Hennepin Count��, Minnesota as depicted on the Certificate of Survey by Paul Schoborg dated March 25, 2012, a copy of which is attached as Exhibit A, and per the legal descriptions attached hereto as Exhibit B, subject to the following conditions: Page 2 of 4 � o� O ;,� g O CITY of ORONO a S� � �� ' -� � RESOLUTION OF THE CITY COUNCIL �'� ;, ..�� Gtiti No. 6 1 3 6 ��kESH�g'� 1. Future development within Tract A shall be subject to escrow far completion of a stormwater master plan per the recommendations of the City Engineer, such escrow amount to be determined at the time residential construction is proposed for tract A. 2. Portions of the property subject to the various Conservation Easements noted herein shall be protected per the recommendations and provisions of the Conservation Design Report and Plan prepared by Jacobson Environmental, PLLC dated February 4, 2012, a copy of which shall be kept on file at the City Offices. 3. Easements and Covenants to be granted or established as noted in this Resolution shall be executed and filed concurrently with filing of this Subdivision Approval Resolution. 4. The approvals granted in this Resolution shall become effective only when all conditions of approval requiring actions by the Developer have been satisfied. 5. The City Clerk shall release this Subdivision Approval Resolution for filing only upon certification by the City Attorney, Planning & Zoning Coordinator and City Engineer that all requirements of the subdivision regulations have been satisfied. 6. This Subdivision Approval Resolution shall be filed by the City of Orono with the Hennepin County Recorder on or before October 23, 2012 together with executed copies of the easements and covenants pertinent thereto. In that event, it will be necessary to file a new application with the City of Orono for subdivision review. Adopted by the City Council of Orono this 23rd day of April, 2012.
