HomeMy WebLinkAboutResolution 6134 � o� O ��,� _ O CITY of ORONO ,�;, � � (�' � ,:�� � RESOWTION OF THE CITY COUNCIL ��� , � .:�`s G'�' NO. 6 1 3 d �kESH�4� A RESOLUTION GRANTING VARIANCES TO MUNICIPAL CODE SECTIONS 78-1279 AND 78-1605,AND A CONDITIONAL USE PERMIT PURSUANT TO SECTIONS 78-418 & 78-916 FILE NO. 12-3548 WHEREAS, Orono Public School District ISD 278 (hereinafter "the Owner") is the owner of the properties located at 685 Old Crystal Bay Road North (hereinafter the "Property") within the City of Orono (hereinafter the "City") and legally described as Government Lot 1, Section 33, Township 118, Range 23 West of the 5�' Principal Meridian, Hennepin County, Minnesota; and WHEREAS, the Owner has made application to the City for variances to Orono City Code Sections 78-1279 and 78-1605 to construct an open-sided 924 square foot pavilion with a 330 square foot deck to be located approximately 85 feet from the OHW of Lake Classen where a 150 foot structure setback is normally required and 5 feet from the delineated wetland edge where a 70 foot wetland buffer and buffer setback would normally be required; and WHEREAS, the Owner has made application to the City for variances to Sections 78-1279 and 78-1605 to construct two 142 square foot observation platforms and after-the-fact approval for three recently constructed 142 square foot observation platforms located approximately 5 feet from the OHW of Lake Classen and the delineated wetland edge where a 150 foot structure setback is required from the OHW; and WHEREAS, the Owner has made application to the City for a conditional use permit pursuant to Orono City Code Section 78-418 because School use is a conditional use in the RR-1B Zoning District and any changes to that use require CUP approval; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on March 19, 2012, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. This application was reviewed as Zoning File #12-3548. 2. The City's Wetland Specialist has reviewed the plans and has made a number of recommendations regarding buffers to mitigate the impacts of the proposed pavilion/deck structure. 3. The walkways and platforms along the shoreline are an allowed use in the wetland buffer per Code Section 78-1606(b)(3) but require a variance because these wetlands are located along the shoreline. 4. The Planning Commission reviewed this application on March 19, 2012 and on a vote of 6 - 0 found that with conditions the application will satisfy the requirements for granting of the requested variances and conditional use permit: a. The Applicant will provide evidence of the appropriate MCWD approval prior to issuance of City building permits for the project. b. The Applicant will apply for and receive the appropriate building permits prior to commencement of the pavilion project and prior to construction of additional observation platforms. c. The Applicant will provide an erosion control plan and final buffer mitigation plan to be approved administratively prior to issuance of building permits. 5. The City Council makes the following additional findings regarding this application: a. The requested variances and CUP are necessary for the provision of educational resources vital to the Orono School District's Environmental Learning Program, and play a key role in the school's academic programs including science, art and environmental systems. The City finds that raising environmental awareness of students by utilizing actual outdoor locations for hands on experience is in keeping with the City's environmental goals and policies, and that providing accessibility to the lakeshore and wetlands adjacent to the school campus for public educational purposes is appropriate and meets the criteria for establishing a practical difficulty. c. Per the recommendations of the City's Wetland Specialist, establishment of wetland buffer areas adjacent to the edge of the wetland in the area of the proposed pavilion would be preferable to the proposed location of such buffers behind the pavilion, and will mitigate the impact of structure within the required buffer axea. 4. The City Council considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the Applicant and the public, and the effect of the proposed conditional use and variances on the health, safety and welfare of the community as well as the impact on properties in the vicinity. 6. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances and conditional use permit would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Applicant, but is necessary to alleviate a practical difficulty; is necessary to preserve a substantial property right of the Applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants variances to Orono City Code Sections 78-1279 and 78-1605 to construct an open-sided 924 square foot pavilion with a 330 square foot deck to be located approximately 85 feet from the OHW of Lake Classen where a 150 foot structure setback is normally required and 5 feet from the delineated wetland edge where a 70 foot wetland buffer and buffer setback would normally be required; and grants variances to Sections 78-1279 and 78-1605 to construct two Page 3 of 5 � O� O ��� O CITY of ORONO ��_ � ,�� � �; .�,aw� � RESOLUTION OF THE CITY COUNCIL ,�, � ,., .,, � G� No. 6 � 34 ��x'Esx��``� 142 square foot observation platforms and after-the-fact approval for three recently constructed 142 square foot observation platforms located approximately 5 feet from the OHW of Lake Classen and the delineated wetland edge where a 150 foot structure setback is required from the OHW; and grants a conditional use permit pursuant to Orono City Code Section 78-418 for the requested changes to the school use; subject to the following conditions: l. Council approval is based on the site plan submitted by the Owner, attached to this Resolution as Exhibit A, subject to relocation of the proposed buffer mitigation areas to a location adjacent to the wetland edge, subject to approval of the City's Wetland Specialist. Any changes or amendments to these plans may require further Planning Commission and City Council review. 2. The Owner shall comply with the following conditions of approval: a. Owner shall adhere to the City's erosion control regulations as well as the permitting requirements of the MCWD, and shall provide evidence of the appropriate MCWD approval prior to issuance of City building permits for the proj ect. b. Owner shall provide an erosion control plan and final buffer plan to be approved administratively prior to issuance of building permits. c. Owner shall apply for and receive the appropriate building permits prior to commencement of the pavilion project and prior to construction of additional observation platforms. d. Owner shall provide escrow in an amount to be determined with regard to wetland buffer establishment associated with the pavilion construction. 3. Authorities granted by this resolution run with the Property not with the Owner, but are permissive only and must be exercised by obtaining the appropriate building permits for platforms and pavilion. 4. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor.
