The resolution giving the property to the City states that the property is to be used for park and rec purposes. Once it ceases to be used for park and rec purposes by the city it reverts back to the State. I am not aware of a way around this condition. Perhaps the city and state can prepare some sort of agreement – but that will take time – if it is even possible. 2) The ROW can be vacated, not sold. There are two tiny slivers of lakeshore property on the south side of Bayside Road that are also associated with this property. Additionally, there are two City of Orono deeded tax forfeit properties (PID 05-117-23-24-0117 and 05-117-23-24-0118) separated by an “unimproved” ROW of Park Street on the lake side of Bayside Road. The Buyer of the property is interested in owning all 3 of the “City” properties. Attached are: * Screen shot from the Statute (from the Buyer) * Deed doc# 1335103 * Contents of the street file for 3640 Bayside Road (containing some interesting history/info) Questions: Can the City convey the two PIDs to the Buyer? If so, what is the process? If not, why? Can the City vacate the portion of Park St landward of the OHWL? Of course they have a purchase agreement which expires in about 14 days.... Is it possible to get an initial response from you this week? If the Buyer makes an application to vacate Park Street there will be an application number to bill your time to... If not, I can tell him there will be a cost and he will be expected to pay it (What is an estimated cost for your review?) Thanks!
