A RESOLUTION
GRANTING VARIANCES TO
MUNICIPAL ZONING CODE
SECTIONS 78-350, 78-1279 and 78-1288
FILE N0. 12-3541
WHEREAS, Robert Scott Richter and Tina Marie Richter, a married couple
(hereinafter"the Applicants") are the owners of the property located at 3508 Ivy Place within the
City of Orono (hereinafter the "City") and legally described as: Lot 183 and the Southeasterly
Half of Lot 182, Taylors Subdivision of Spring Park Lots, Hennepin County, Minnesota
(hereinafter the"Property"); and
WHEREAS, the Applicants have made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-350 to allow construction of a new
residence on an existing lot 14,211 square feet (0.32 acre) in area and 95' in width at the OHWL
& 75' in width at the 75-foot setback where 21,780 square feet (0.5 acre) in area and 100-feet in
width are normally required; and
WHEREAS,the Applicants have made application to the City of Orono for a variance to
Orono Municipal Zoning Code Section 78-350(B) to allow a 10-foot side street setback from the
unimproved ROW of Ivy Lane where a 15-foot setback is normally required in conjunction with
the construction of a new residence; and
WHEREAS, the Applicants have made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-1279 to allow an average lakeshore
setback encroachment for portions of the proposed 10'x 10' covered lakeside deck; and
WHEREAS, the Applicants have made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-1288 to allow 46% hardcover within the
75'-250' zone where 25% is normally allowed in conjunction with the construction of a new
home; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held
a public hearing on January 17, 2012 at which times all persons desiring to be heard concerning
this application were given the opportunity to speak thereon.

NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File 12-3541.
2. The Property is located in the LR-1C One Family Lakeshore Residential Zoning
District which requires a minimum lot area of 0.5 acres and a minimum lot width
of 100'.
3. The Planning Commission reviewed this application at a public hearing held on
January 17, 2012 and recommended approval of variances based on the following
findings:
a. The Property contains 14,211 square feet (0.32 acre) in axea and has 95 feet in
width at the OHWL and 75 feet in width at the 75-foot lake setback.
b. The Property currently exists as two separate addresses (3508 and 3510 Ivy
Place) and two separate PIDs which should be combined prior to issuance of a
building permit for a new home.
c. Sanitary sewer is available.
d. There is no additional land available to bring the lot area into conformity.
e. The Applicants' proposal results in an overall total reduction in hardcover
from the current levels by 384 s.f. within the 0-75' zone; by 1,128 square feet
within the 75' — 250' zone on the property and 2,209 s.f. of hardcover
encroachments within the ROW.
f. The Applicants' plan includes restoration of the adjacent Ivy Lane ROW and a
planting plan to screen and delineate the ROW from the Property.
g. There are "old growth" trees on the Property which offer screening from the
adjacent property and should be protected.

h. The topography and shape of the Property creates a practical difficulty for
locating the home in a conforming location without creating an awkward
configuration or requiring the use of the adjacent Ivy Lane ROW for access.
i. The Applicants' request will alleviate a practical difficulty inherent to the
Property and not created by the Applicants.
j. The Applicants' request will not alter the essential character of the
neighborhood and will result in minimal negative impact on adjacent
properties.
k. The Applicants' request is in harmony with the purpose and intent of the
ordinance.
l. The Applicants have demonstrated that enforcing the 75' to 250' zone
hardcover, side street and average lakeshore setbacks, lot area and lot width
provisions of the Zoning Ordinance deprive the Applicants of the reasonable
use of their Property.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments by
the Applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this Property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance would not adversely affect traffic conditions, light, air nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the Applicants, but is necessary to alleviate a practical difficulty;
is necessary to preserve a substantial property right of the Applicants; and would
be in keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants a
variance to Orono Municipal Zoning Code Section 78-330(B) to allow construction of a new
residence on an existing lot 14,211 square feet (0.32 acre) in area and 95' in width at the OHWL
& 75' in width at the 75-foot setback where 21,780 square feet (0.5 acre) in area and 100-feet in

width are normally required; and a variance to Section 78-350(B) to allow a 10-foot side street
setback from the unimproved ROW of Ivy Lane where a 15-foot setback is normally required;
and Section 78-1279 to allow an average lakeshore setback encroachment for portions of the
proposed 10'x 10' covered lakeside deck; and Section 78-1288 to allow 46% hardcover within
the 75'-250' zone where 25% is normally allowed in conjunction with the construction of a new
home, subject to the following conditions:
1. Council approval is based on the survey, building plans and landscape plan submitted by
the Applicants and annotated by City staff, attached to this Resolution as Exhibits A, B
and C. Any amendments to the plans which are not in conformity with City codes will
require further Planning Commission and City Council review.
2. Hardcover shall not increase above the approved levels as follows: 0% hardcover within
the 0-75' zone; and 3,549 square feet(46%) of hardcover within the 75' to 250' zone.
3. Applicants must provide a copy of the recorded deed reflecting combination of the two
tax parcels prior to issuance of a building permit for the proposed residence.
4. The Applicants shall remove all encroachments from the ROW of Ivy Lane and restore
the grades according to the approved plans and the City Engineer's recommendations
prior the C.O. for the proposed residence.
5. The Applicants shall implement the approved landscape plan attached as Resolution
Exhibit C prior to the issuance of a C.O. for the proposed residence.
6. The Applicants' exterior lighting shall be in conformance with the City's lighting
standards; downward-directed exterior lighting fixtures are preferred.
7. The Applicant's building permit survey and plans shall address the city engineer's
comments and recommendations.
8. The home plans submitted are for the purpose of hardcover review. The construction
plans and survey submitted for building permit will be reviewed for conformance with
Orono's building height and number of stories calculation.
9. Authorities granted by this resolution run with the Property not with the Applicants, but
are permissive only and must be exercised by obtaining a building permit for the new
construction and commencing construction of said project. A framing inspection must be

completed within one year of the date of Council approval, or the variance will expire on
that date(February 13, 2013).
10. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
The undersigned Applicants have read, understand and hereby agree to the terms of this
resolution and on behalf of the Applicants and the Applicants' heirs, successors and assigns,
hereby agree to the recording of this resolution in the chain of title of the Property.
Adopted by the Orono City Council on the 13th day of February, 2012.
