O CITY of ORONO <br /> '�,�� _ <br /> t�_ <br /> +-� '�� � :�' � RESOLUTION OF THE CITY COUNCIL <br /> , <br /> �'� �' `�` �,� N O. 6 l O 7 <br /> ��kESH�4� <br /> A RESOLUTION <br /> GRANTING A ONE-YEAR EXTENSION <br /> TO THE EFFECTIVE PERIOD <br /> OF PRELIMINARY PLAT APPROVAL <br /> ESTABLISHED PER RESOLUTION NO. 5716 <br /> FILE NO. 07-3334 <br /> WHEREAS, on December 10, 2007, the City Council of the City of Orono <br /> (the "City") adopted Resolution No. 5716 granting preliminary plat approval for <br /> subdivision of property located at 3405 High Lane; and <br /> WHEREAS, City of Orono Municipal Code Section 82-117 establishes <br /> that preliminary plat approval is effective for one year from the date of such approval, <br /> and failure to file a complete final subdivision application within this time period shall <br /> be considered as formal withdrawal of the proposed subdivision; and <br /> WHEREAS, preliminary plat approval runs with the land, not the <br /> applicant; and <br /> WHEREAS, due to market conditions, the applicant requested and <br /> received three, one-year extensions of the effective period of preliminary plat <br /> approval granted in preliminary plat resolution No. 5716 with resolution numbers <br /> 5787, 5878, and 6017; and <br /> WHEREAS, the current one-year extension of the effective period of <br /> preliminary plat approval expires on January 14, 2012; and <br /> WHEREAS, due to market conditions and other reasons, the applicant <br /> would like to temporarily postpone requesting Final Plat approval. The applicant has <br /> requested an additional one year extension of the effective period of preliminary plat <br /> approval to January 14, 2013. <br /> Page 1 of 2 <br />
