A RESOLUTION
GRANTING SITE PLAN APPROVAL
PURSUANT TO CITY CODE SECTION 78-821
WITH VARIANCES FROM CITY CODE SECTION 78-1605
FOR PROPERTY LOCATED AT
2750 KELLEY PARKWAY
FILE #14-3651
WHEREAS, the City of Orono is a municipal corporation organized and
existing under the taws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono (hereinafter "City
Council") has adopted land development regulations for the orderly, economic and safe
development of land within the City; and
WHEREAS, the City of Orono (hereinafter the "Owner") is the owner of
the property located at 2750 Kelley Parkway and legally described as:
Lot 1, Block 1, City of Orono Addition, Hennepin County, Minnesota (hereinafter
the "Property"); and
WHEREAS, the Owner has applied for Commercia� Site Plan Approval to
allow improvements to the parking areas and to construct an approximate 9,000 square
foot addition to and conduct modifications to the existing building on the Property;
WHEREAS, the Owner has applied for a variance from the requirements
of City Code Section 78-1605 in order to permit a portion of the proposed parking area to
be set back 20 feet from the delineated wetland edge where a 35 foot setback from the
wetland is required; and
WHEREAS, after due published and posted notice, a public hearing was
held by the Orono City Council on April 14, 2014 regarding said commercial site plan,
and variance requests and all interested persons were given an opportunity to be heard;
and
WHEREAS, the Orono City Council makes the following findings in
regard to this application for a commercial site plan, and wetland setback variance
based on the following findings:

1. The Property has 614,747 square feet or 14.11 gross acres in area and has
approximately 680 feet in width along Kelley Parkway.
2. The proposed police garage makes up approximately 7,800 square feet of the
9,000 square feet of structural additions proposed.
3. There will be no change in the number of exterior parking stalls on the Property.
Including 3 handicap stalls, 86 exterior parking stalis will continue to be provided
on the Property.
4. 14 new parking stails are proposed to be included within the police garage
addition.
5. The existing building and all proposed structural additions on the Property will
meet the applicable RR-1 B zoning requirements regarding setbacks and height.
6. The current single parking lot access off of Kelley Parkway will be separated into
a public access and a designated access for police business only. The newly
created police access will move 50 feet to the east; and the new access for the
public will be located in line with the western access to the medical building
across Kelley Parkway approximately 120 feet from Old Crystal Bay Road.
7. The necessary reorientation of the police access point and the curve of the
existing parking area serving the police department serve as practical difficulties
and make it difficult to avoid encroaching into the 35-foot wetland setback on the
southernmost point of the wetland.
8. There is adequate space with which to provide foundation plantings between the
parking area and the building.
9. The proposed windows, orientation, architectural materials and height variation
will relieve the potential visual monotony of the building.
10. The building additions will coordinate with the existing buildings on the City Hall
campus.
11. The proposed additions and parking lot changes will not alter the essential
character of the neighborhood and will result in minimal or no negative impact on
adjacent properties. �
12. The request is in harmony with the purpose and intent of the ordinance.
13. The Owner has demonstrated that enforcing the provisions of the Zoning
Ordinance will deprive the Applicants of the reasonable use of their Property.

14. The request conforms to the 12 site evaluation criteria outlined within City Code
Section 78-145 regarding Site Plan review.
The City Council has considered this application including the reports by City staff,
comments by the public, and the effect of the proposed variance on the health, safety
and welfare of the community.
The City Council finds that the conditions existing on this Property are peculiar to it and
do not apply generally to other properties in this zoning district; that granting the
variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or
other danger to neighboring property; would not merely serve as a convenience to the
Owner, but is necessary to alleviate a practical difficulty; is necessary to preserve a
substantial property right of the Owner; and would be in keeping with the spirit and intent
of the Zoning Code and Comprehensive Plan of the City.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Orono does hereby grant Commercial Site Plan Approval to allow improvements to
the parking areas and to construct an approximate 9,000 square foot addition and
conduct modifications to the existing building on the Property; and grants a variance
from the requirements of City Code Section 78-1605 in order to allow a portion of the
new parking lot be set back 20 feet from the delineated wetland edge where a 35 foot
setback from the wetland is required, subject to the following conditions:
1. Council approval is based on the site plan attached to this Resolution as Exhibit
A. Any amendments to the approved plans which are not in conformity with City
codes will require further City Council review.
2. The Owner must obtain permits pursuant to this approval and commence
construction within one year from the date of this Resolution or the approvals
granted within this resolution will expire.
