HomeMy WebLinkAboutResolution 6354 � � o� � O CITY of ORONO �_. ?�t � � � ��' =' � RESOLUTION OF T��IjY COUNCIL '� ��.�, � 0 4 � G NO. ��kESH�g'� A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A COLUMBARIUM WALL, MEMORIAL LANDSCAPE WALL, AND OPEN GAZEBO STRUCTURE PURSUANT TO ORONO CODE SECTION 78-418 FILE NO. 13-3641 WHEREAS, Jerilyn Lowe (hereinafter the "Applicant") has made an application on behalf of Trinity Lutheran Church, the owner (hereinafter the "Owner") of property located at 2060 Sixth Avenue North within the City of Orono (hereinafter the "City") and legally described as follows: See Attached Exhibit A (hereinafter"the Property"); and WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, pursuant to State Statutes 412 et. seq. and 462 et. seq., the City Council of the City of Orono has adopted zoning regulation for the protection of the public health, safety and general welfare; and WHEREAS, the Property contains an existing church and is located in the RR-1 B one family rural residential district. A church is an allowed use within residential districts by conditional use permit; and WHEREAS, the church on the Property has an existing conditional use permit; and WHEREAS, on October 23, 2013, the Applicant made an application requesting a conditional use permit to permit decorative walls and an open sided gazebo structure to be constructed as part of a memorial garden on the Property pursuant to City Code Section 78-418 (4); and WHEREAS, on October 23, 2013, the Applicant also made an application requesting a conditional use permit for construction of an above-grade columbarium pursuant to City Code section 78-418(14); and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.3595 et. seq. and the City of Orono Zoning Codes, on November 18, 2013, the Orono Planning Commission held a public hearing for the application at which time all persons desiring to be heard concerning the application were given the opportunity to speak thereon. This application was reviewed as Zoning File #13-3641. 2. The Property is located in the RR-1 B Rural Residential Zoning District. 3. A church is an allowed conditional use within the RR-1 B Rural Residential Zoning District. 4. Trinity Lutheran Church has existed on the Property since the 1950's and operates under a CUP issued via Resolution No. 2423 Adopted May 9, 1988. 5. The Planning Commission reviewed this application at a public hearing held on October 21, 2013 and voted 7 for and 0 against on a motion to approve the conditional use permit for the columbaria wall as described herein based on the following findings: a) The proposed columbaria wall complies with all setback requirements. b) The proposed open gazebo and memorial wall comply with all setback requirements. c) The Applicant has provided a landscape plan which provides the required screening. d) The proposed use is consistent with the Community Management Plan; e) The proposed use is compliant with the zoning code, including any conditions imposed on specific uses as required by Article V, Divisions 2 and 3 of the City Code; fl The Property is able to be adequately served by police, fire, roads, and stormwater management; g) The Property is provided with an adequate water supply and sewage disposal system; h) The proposed use is not expected to generate excessive demand for public services at public cost; i) The proposed use is compatible with the surrounding area as used both presently and as it is planned to be used in the future; j) The proposed use is consistent with the character of the surrounding area, unless a change of character is called for in the Community Management Plan; k) The proposed use is compatible with the character of buildings and site improvements in the surrounding area, unless a change of character is called for in the Community Management Plan; Page 2 of 4 � � o� O _, O CITY of ORONO a�. - � ' � RESOLUTION OF THE CITY COUNCIL �'� � '��� � �,��' No. 6 3 5 4 ��kESH�g'� I) The proposed use is not expected to substantially impair the use and enjoyment of the property in the area or have a materially adverse impact on the property values in the area when compared to the impairment or impact of generally permitted uses; m) The proposed use is provided with screening and buffering adequate to mitigate undesirable views and activities likely to disturb surrounding uses; n) The proposed use wil� not create a nuisance which generates smoke, noise, glare, vibration, odors, fumes, dust, electrical interference, general unsightliness, or other means; o) The proposed use will not cause excessive non-residential traffic on residential streets, parking needs that cause an inconvenience to adjoining properties, traffic congestion, or unsafe access; p) The site is designed to take into account the natural, scenic, and historic features of the area and to minimize environmental impact; q) All exterior lighting shall be so directed so as not to cast glare toward or onto the public right-of-way or neighboring residential uses or districts; and r) The proposed use is not detrimental to the public health, public safety, or general welfare. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a conditional use permit to permit decorative walls and an open sided gazebo structure to be constructed as part of a memoria► garden on the Property pursuant to City Code Section 78-418 (4); and a conditional use permit allowing construction of an above-grade columbarium pursuant to City Code section 78-418(14), subject to the following conditions: 1. Council approval is based on the survey/site plan, columbarium plan, gazebo rendering, landscape plans submitted by the Applicant and annotated by City staff, attached to this Resolution as Exhibits B, C, D 8 E (hereinafter the "Plans"). Any amendments to the Plans which are not in conformity with City codes will require further Planning Commission and City Council review. 2. The Plans submitted for permit will be reviewed to ensure compliance with the City's regulations. 3. Authorities granted by this resolution run with the Property not with the Applicant or Owner, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the conditional use permit will expire on that date (December 9, 2014). Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned Owner has read, understands and hereby agrees to the terms of this resolution and on behalf of the Owner and the Owner's heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the Property.
