HomeMy WebLinkAboutResolution 6328 .� o.� � � , � CITY of ORONO � �, y�� � RESOLUTION OF THE CITY COUNCIL �' �� No. b 3 Z �8 ���ESH�g'� A RESOLUTION APPROVING THE PLAT OF PINE VIEW FILE #13-3626 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has adopted subdivision and land development regulations for the orderly, economic and safe development of land within the City; and WHEREAS, on November 13, 2012, the City Council considered the preliminary plat application by John H. Lein and Connie Jean Lein, a married couple for subdivision of property identified as property identification number (PID) 28-118-23-42-0002 and legally described as Lot 1, Block 1, Fazendin Forest, Hennepin County, Minnesota (hereinafter the "Property"); and WHEREAS, on November 13, 2012, the City Council adopted Resolution No. 6180 granting Preliminary Plat Approval for the proposed subdivision of the Property into four(4) single family residential lots, including a private road outlot; and WHEREAS, on September 20, 2013 the Property was sold to Stephenson Holdings, Inc., a Minnesota Corporation (hereinafter the "Owner"); and WHEREAS, the Owner has completed or has agreed to complete all other requirements of the platting regulations of the City including: 1. Completion of all platting requirements of Preliminary Plat Resolution No. 6180. 2. Dedication on the plat of Drainage and Utifity Easements as required in Resolution No. 6180. 3. Platting of a private road outlot 50 feet in width designated on the plat as Outlot A, and granting to the City of a Road, Drainage and Utility Easement as well as establishing covenants for maintenance of said private road. 4. Dedication of all Tree Preservation; Conservation; and Wetland and Wetland Buffer Easements as required in Resolution No. 6180. 5. Dedication of a Public Trail Easement over the southerly 10 feet of Lot 1 and Lot 4 concurrent with the 10' perimeter drainage and utility easement.. Provision to the City of a titie opinion for the Property and certified copies of all recorded easements currently affecting the Property. 7. Payment of Park Dedication Fee in the amount of$16,650. 8. Payment of Storm Water and Drainage Trunk Fee in the amount of $40,588.80. 9. Execution of a development agreement and provision of securities for the required improvements subject to City attorney approval. NOW, THEREFORE, BE IT RESOLVED that based on the findings of Resolution No. 6180, the City Council of the City of Orono does hereby approve the four-lot plat of PINE VIEW, Hennepin County, Minnesota (a copy of which is attached as Exhibit A) subject to the following conditions: 1. The Final Plat approval granted by this Resolution shall expire six months from the approval date (April 14, 2014). 2. Development within PINE VIEW is subject to the Conclusions, Orders and Conditions enumerated within Preliminary Plat Resolution No. 6180. 3. The approvals granted in this Resolution shall become effective only when all conditions of approval requiring actions by the Owner have been satisfied. 4. The Final Plat shall adhere to the Vegetation Management Plan by Svoboda Ecological Resources dated September 18, 2012. 5. The Final Plat shall adhere to the Conservation Design Master Plan as presented in Item 4 beginning on Page 2 of the Conservation Design Report by Svoboda Ecological Resources dated September 18, 2012 except that the Planning Commission's recommendation for the existing driveway and tree stand shall be implemented as follows: The existing trees within the area of the wheel-strip driveway should be preserved and leave most of the wheel strip driveway as-is. The Owner shall remove the driveway curb cut at CSAH 6 and at the outlet of the driveway to the north and restore the ditch area. Trees or shrubs shall be planted in the area of the driveway opening to close the opening. 6. The City Clerk shall release the plat documents for filing only upon certification by the City Attorney, Planning & Zoning Coordinator and City Engineer that all requirements of the platting regulations have been satisfied. The aforesaid plat shall be filed by the City of Orono with the Hennepin County Recorder on or before April 14, 2014 together with a certified original copy of this resolution and executed copies of the easements and covenants pertinent thereto. The approval granted by this Resolution shall expire if the conditions of this Resolution have not been met or the plat has not been filed by the date specified above. In that event, it will be necessary to file a new application with the City of Orono for subdivision review. Adopted by the City Council of Orono this 14th day of October, 2013.
