A RESOLUTION
GRANTING VARIANCES
FROM ORONO MUNICIPAL CODE
SECTIONS 78-1435, 78-1439, 78-1685, and 78-1700
FILE NO. 13-3618
WHEREAS, Edward A. Lagerstrom and Julie L. Lagerstrom, a married
couple, (hereinafter"Applicants") are the owners of the property located at 2248 Shadywood
. Road within the City of Orono (hereinafter "City") and legally described as: Lot 7, Block 1,
"Wiley's Park" Lake Minnetonka, Hennepin County, Minnesota (hereinafter "the Property");
and
WHEREAS, the Applicants have made application to the City for variances
from Orono Code Sections 78-1435 and 78-1439 in order to construct a detached garage
with overhead doors facing the street, 20 feet from the rear lot line where a 30-foot setback is
required; and
WHEREAS, the Applicants have made application to the City for a vairance
from Orono City Code Section 78-1685 to allow constrcution of the detached garage
resulting in 15.4% structural coverage, 66 square feet over the allowed 15% structural
coverage levef; and
WHEREAS, the Applicants have also made application to the City for
variances from Orono City Code Section 78-1700 to allow 3,785.4 square feet (26.1%)
hardcover where 3,616.7 square feet (25%) is permitted and 3,193.7 square feet (22.1%)
currently exists in conjunction with construction of the proposed detached garage, stair and
driveway; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission
held public hearings on August 19, and September 16, 2013, at which times all persons
desiring to be heard concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File#13-3618.

2. The Property is located in the LR-1 C zoning district, where 0.5 acres is the

minimum lot area and 100 feet is the minimum defined lot width.
3. The Planning Commission reviewed this application on September 16, 2013
and on a vote of 7 - 0 recommended approval of the variances, based on the
following findings:
a. The Property has approximately 14,467 square feet (0.33 acre) acre in
area and has 52 feet in width.
b. The Property is located in Tier 1 of Orono's Stormwater Quality
Overlay District and is limited to 25% hardcover based on gross lot
area.
c. The Property does not have adequate width to construct a side-load
garage.
d. The Applicants propose to move the new detached garage 20 feet
away from the road, 20 feet further than existing, in order to
accommodate off-street parking and to create a safer entrance to the
garage.
e. The location of the proposed detached garage results in additional
driveway hardcover.
f. The proposed detached garage will meet the 10 foot side yard setback
requirements.
g. The topography of the Property combined with an existing mature tree
serves as a practical difficulty preventing the garage from being
constructed at the 30 foot setback as required. Significant filling would
need to occur to place the garage at the conforming setback.
h. Construction of the detached garage at the conforming setback would
further impact the light, air and open space for the neighbors currently
provided by the current plan.
i. The Applicants have proposed to install vegetative screening along the
north/lake side of the detached garage to screen the additional garage
massing from the adjacent property.
j. The Applicants' request will alleviate a practical difficulty inherent to

the existing location of the detached garage and its proximity to
Shadywood Road and not created by the Applicants.
k. The Applicants' request will not alter the essential character of the
neighborhood and will result in minimal negative impact on adjacent
properties.
I. The Applicants' request is in harmony with the purpose and intent of
the ordinance.
m. The Applicants' proposal is consistent with the comprehensive plan.
4. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff,
comments by the Applicants and the public, and the effect of the proposed
variances on the health, safety and welfare of the community as well as the
impact on properties in the vicinity.
5. The City Council finds that the conditions existing on this Property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variances would not adversely affect traffic conditions, light, air
nor pose a fire hazard or other danger to neighboring property; would not
merely serve as a convenience to the Applicants, but is necessary to alleviate
a practical difficulty; is necessary to preserve a substantial property right of the
Applicants; and would be in keeping with the spirit and intent of the Zoning
Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants the following:
variances from Orono Code Sections 78-1435 and 78-1439 in order to construct a detached
garage with overhead doors facing the street, 20 feet from the rear lot line where a 30-foot
setback is required; a variance from Code Section 78-1685 to allow constrcution of the
detached garage with a 23' x 22' defined footprint resulting in 15.4% structural coverage, 66
square feet over the allowed 15% structural coverage level; and a variance from Orono City
Code Section 78-1700 to allow 3,785.4 square feet (26.1%) hardcover where 3,616.7 square
feet or 25% is permitted and 3,193.7 square feet (22.1%) currently exists in conjunction with
construction of the proposed detached garage, stair and driveway; subject to the conditions
listed below:

Applicants and annotated by City staff, attached to this Resolution as Exhibit A & B.
Any amendments to these plans may require further Planning Commission and City
Council review.
2. Hardcover shall not increase above 26.1% as approved. The Applicants are hereby
notified that any changes to the plans or the Property which result in an increase in
hardcover above the approved level will require further Planning Commission and
City Council review.
3. The Applicants shall install vegetative screening along lake side of the garage and
wall to screen the additional garage massing from the adjacent properties and from
the lake.
4. Authorities granted by this resolution run with the Property not with the Applicants, but
are permissive only and must be exercised by obtaining building permits for the new
construction and commencing construction of said project. A framing inspection must
be completed within one year of the date of Council approval, or the variances will
expire on that date (October 14, 2014).
5. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any
authority granted herein, and shall be punishable as a misdemeanor.
6. The undersigned Applicants have read, understood and hereby agree to the terms of
this resolution and on behalf of their heirs, successors and assigns, hereby agree to
the recording of this resolution in the chain of title of the Property.
