RELEASE OF ENCROACHMENT AGREEMENT
AGREEMENT made this loth day of ,rt� 1 � , 2017, by and between the
CITY OF ORONO, a Minnesota municipal corporation ("City"); and SEAN FOY, a single
person ("Landownei7•"),
1. BACKGROUND. The City granted the Landowner permission to encroach upon
the City's easement area pursuant to an Encroachment Agreement dated August 4, 2009, and
recorded September 1, 2009 with the Hennepin County Recorder as Document No. A9414702
for property legally described as: Lot 9, Wallace's Addition to the Village of Minnetonka
Beach ("Property"). The City Al A er desire to release the Property from the
Encroachment Agreement.
2. RELEASE OF ENCROACHMENT AGREEMENT. The parties hereby
release the existing Encroachment Agreement as it relates to the Property.
3. RECORDING. This Release of Encroachment Agreement shall be recorded
against the title to the Property and shall run with the land.
