This application was reviewed as Zoning File LA24-000028. 2. The Property is guided in the 2040 Orono Community Management Plan (CMP) for single family residential use,specified as Rural Residential(1 unit per 2 acres) and Rural Preserve (1 unit per 5 acres). The proposed development with single family homes is consistent with the provisions of the CMP, and is consistent with surrounding development. The Property is not located within the MUSA and will be served by septic and private water. 3. The Properties are zoned RR-1A One Family Rural Residential District (5.0 acres) north of Bayside Road. South of Bayside Road,the zoning is split between RR-1B One Family *to CITY OF ORONO RESOLUTION OF THE CITY COUNCIL 1 � No.7488 4Es 0- -Rural Residential District (2.0 acres) and LR-1A Single Family Lakeshore Residential District(2.0). 4. The proposed plat would create one new buildable lot. Lot 1, Block 2 is 21.62 acres in area and 370 feet at the OHWL. Lot 1,Block 1 is 15 acres in area and a width of 890 feet. Lot 2.Block 1 is 14.48 acres in area and a width of 660 feet. The three newly created lots are conforming to their zoning districts as it relates to area and lot width. 5. The Property to the south of Bayside Road lies within 1,000' of Lake Minnetonka requiring conformance with the hardcover regulations of the Stormwater Quality Overlay District. The entire Property is within Hardcover Tier 1 allowing 25% impervious surface. The Properties to the north of Bayside Road are exempt from hardcover regulations. 6. No additional variances have been requested. The development of the vacant lots will be required to meet all zoning standards. CONCLUSIONS,ORDER AND CONDITIONS NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the findings noted above,the City Council of the City of Orono hereby grants Preliminary Plat Approval for a 3-lot subdivision per the Preliminary Plat survey/drawing by Mark S.Gronberg of Gronberg& Associates, Inc. dated June 28, 2024 and attached hereto as Exhibit B, subject to the following conditions: 1) Lot Standards. Any proposed improvements must meet all setbacks requirements of the Zoning Code. 2) Septic and Private Well. The Properties are not located within the Metropolitan Urban Service Area (MUSA) and therefore will be served by private septic systems. The properties will also be served by individual private water supply wells. 3) Stormwater and Drainage Improvements. Final plat approval is subject to Minnehaha Creek Watershed District(MCWD)approval and permits as required.Final plat approval shall not be granted until the Developer has provided evidence that all required MCWD permits have been obtained. Upon building permit issuance, the property owner will be required to comply with individual lot stormwater and erosion control management practices. 4) Drainage and Utility Easements. If applicable, Drainage Easements shall be granted over any stormwater facilities required by the Minnehaha Creek Watershed District; the Drainage Easements shall be shown on the Plat. 5) Development Fees. A. Park Dedication Fee. The subdivision is subject to the standard Park Dedication Fee requirement. The Park Dedication Fee is outlined in the City's current 2024 Fee Schedule and applied to each newly created lot on a per lot basis. Park dedication fees are based on Hennepin County's assessment of the predeveloped land value. Based on the 2024 Fee Schedule,the Park Dedication Fee will be due for Lot 1,Block 2 in the amount of$3,710.81. B. Stormwater and Drainage Trunk Fee. The development is subject to the Stormwater and Drainage Trunk Fee, as established in the 2024 Fee Schedule of$16,150.00 per new lot for a 5-acre zone. The Storm Water Drainage and Trunk Fee due at the time of Final Plat for 1 new lot will be $16,150.00. 6) City Engineer Approval. Approval of the plat is subject to recommendations of City Engineer. 7) Plans and Specifications. Plans and specifications shall be submitted for review and approval by the City and other appropriate jurisdictions prior to final plat approval,to ensure that the proposed plat will accomplish the intended purposes. Final plat approval will not be granted until MCWD stormwater management plan requirements have been approved and sufficient detail is provided to meet any recommendations by the City Engineer. 8) The Preliminary Plat approval granted by this Resolution shall expire one-year from the approval date(July 8,2025). FINAL SUBMITTALS The following list of final submittals must be submitted to the Planning & Zoning Coordinator at least four (4) weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of the month. These submittals are as follows: 1. Record plat drawings in the form of(1) to-scale digital copy; two (2) mylar copies (one copy for the City's records and one for filing with Hennepin County); and one (1) copy reduced to 1"=200'. Dedication of Drainage and Utility Easements over all stormwater facilities. D. Dedication of Drainage Easements over areas shown as wetlands. E. Dedication of Drainage Easements over all drainageways. F. Naming of plat. 2. Legal documents required: A. Title opinion addressed to the City or a title insurance policy in favor of the City. All owners,mortgage holders or others with property interest indicated therein shall sign the plat and all other documents affected by such interest. B. Private Driveway Easement and Maintenance Agreement. C. The Developer must provide certified copies of all recorded easements currently affecting the property. 3. Plat approval fees to be paid: Total due: $22,910.81 A. Final plat fee: $550.00 B. Park Dedication Fee: $3,710.81 C. Stormwater and Drainage Trunk Fee: $16,150.00 D. Final Plat Escrow: $2,500.00 4. This Approval shall be effective until July 8,2025 per the provisions of Zoning Code Section 82-116.
