GRANT OF PERMANENT EASEMENT
DAVID L. O'KEEFE and MARY A. O'KEEFE, married to each other, hereinafter
referred to as "Grantors", are the fee owners of certain real property located in the City of Orono,
County of Hennepin, State of Minnesota, that is legally described Exhibit A, and depicted on Exhibit
C (the "Property")
Grantors, in consideration of One Dollar ($1.00) and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, do hereby grant and
convey unto the CITY OF ORONO, a Minnesota municipal corporation ("City") as Grantee, its
successors and assigns, forever, the following:
Permanent Easement:
A. Utilities Easement. A perpetual and permanent easement for public utilities
purposes ("Easement") over, on, across, under, and through that portion of the Property
that is legally described on Exhibit B and depicted on Exhibit C ("Easement Area").
Easement includes the right of the City, its contractors, agents, servants, and assigns, to
enter upon Easement Area at all reasonable times to construct, reconstruct, inspect, repair,
and maintain Easement and Easement Area, together with the right to grade, level, fill,

drain, pave, and excavate Easement Area, and the further right to remove trees, bushes,
undergrowth, and other obstructions interfering with the location, construction, and
maintenance of Easement and Easement Area.
The above named Grantors, for themselves, their heirs, successors, and assigns, do
covenant with the City, its successors and assigns, that they are well seized in fee title of Easement
Area; that they have the sole right to grant and convey the Permanent Easement to the City; that
there are no unrecorded interests in Easement Area; and they will indemnify and hold the City
harmless for any breach of the foregoing covenants.
Exhibit A, Exhibit B, and Exhibit C are attached to this Grant of Permanent Easement,
and are incorporated into and made part of the same.

office of the County Recorder in and for Hennepin County, Minnesota.

Line 1. Commencing at Right of Way Boundary Corner B8 as shown on Minnesota Department
of Transportation Right of Way Plat No. 27-130 as the same is on file and of record in
the office of the County Recorder in and for said County; thence on an azimuth of 90
degrees 48 minutes 58 seconds along the boundary of said Plat for 81.52 feet to Right of
Way Boundary Corner B9 and the point of beginning of the line to be described; thence
on an azimuth of 94 degrees 32 minutes 40 seconds for 230.68 feet to Right of Way

95.00 feet of Lot 2, Block 1, DUMAS ORCHARDS, according to the recorded plat thereof,
