� 5. The City Council iinds that granting a Conditional Use
Permit to allow the guest apartment to be constructed within
the detached garage structure will not be detrimental to the
health, safety or general welfare of the public, would not
adversely affect light, air nor pose a fire hazard or other
danger to neiqhboring properties, nor wili it depreciate
surrounding property values and the proposed level of use of
the property wi 11 be in keeping with the intent and objec- -
- tives of the Zoning Code and Comprehensive Plan of the City.

Based upon the above f indings, the Orono City Counci I
h�reby grants a Conditional Use Permit per Municipal Zoning Code
Section �0.20, Subdivision 3 (G) to permit a guest apartment
within the detached garage on the property, subject to the
�'� following conditions:
i . 1. Guest apartment located within the second f loor of the
detached garage may never be rented, but is for the ex-
clusive use of owners, their guests or their employees.

�"2 �� y, 2. The guest apartment must be served by an independent
���° � �, sewer connection to the municipal 1ine.

� r� . 3. Violation of or non-compliance with any of the items and
��a conditions of this resolution shall constitute a violation
��� of the Zoning Code, shall automatically terminate any
x � `� authority granted herein, and shall be punishable as a

k,,,a misdemeanor.

4. The undersigned owner has read, understood ar.d hereb�
agrees to the terms of this resolution and on behalf of
himself, his heirs, successors and assigns, hereby agrees to
the recerding of this resolution in the chain of title of
the property.
