According to the requirements for assessment hearings, property owners need to provide written notice of their objections to the proposed assessment before or at the assessment hearing to be eligible to file an appeal. Credit for Properties with Grinder Pumps There are five properties at the end of Heritage Lane that will need grinder pumps for sewer service. For the 1997 projects at North Long Lake and Bracketts Point there were eleven properties that required grinder pumps. These pumps were bid as part of the two projects and then provided to the property owners. These stations were installed by the plumber hired by the property to complete the sewer connection to the house. The operation and maintenance of the grinder station is the responsibility of the property owner. This method was not the most desirable as the plumbers installing the stations were not familiar with the stations provided, and in one situation the type of station provided was not the best solution for the property. With the large number of mound systems installed every year, area plumbers are experienced in the installation of pumping systems. They install brands of equipment they are familiar with. The use of equipment selected by the plumber results in easier installation and future servicing of the pumping stations. Many plumbers also provide long term service and maintenance for the property owners. Also, since the property owners are responsible for the operation and maintenance of die grinder pump, they should be able to select their own system. This also isolates the City from possible future claims in case of system failure. We are recommending that the property owners with grinder stations be assessed the same amount as the properties with gravity service and then issued a credit for the purchase of a grinder pump system. This system can than be purchased and installed by the plumber that completes the sewer hookup. For the North Long Lake project, the City paid $3,290 each for ten grinder stations. The cost for the one grinder station on the Bracketts Point project was $3,600. We are recommending that the property owners be credited $3,700 for the purchase of their own grinder pump stations. This cost allowance has been included in the proposed project costs. Award of Construction Contract It is important that construction of this project begin as soon as possible to allow for an adequate schedule for completion. Pending no written notices of appeals received at the assessment hearing or possible additional requests for exclusion from the project, we are recommending award of the construction contract at this meeting. The construction contract was bid to include both the Edgewood Hills and Shoreline/ Heritage projects. The Shoreline Heritage project consists of open cut installation of the pipe. The prices received for this work were very reasonable and within the feasibility study cost estimates. The Edgewood Hills project was for directional boring installation of the pipe. The prices received for this work were substantially higher than expected, so this portion of the project is being rebid. r I The contractor has agreed to a change order eliminating the Edgewood Hills directional boring portion of the contract and will complete the Shoreline/Heritage project for the original unit bid prices. Change Order Number 1 will reduce the contract from $455,920.30 to $279,194.07. We are recommending awarding the contract for the project to G.L. Contracting of Medina for $279,194 including Change Order Number 1. COUNCIL ACTION REQUESTED; 1. A RESOLUTION ADOPTING THE SHORELINE DRIVE, HERITAGE DRIVE AND HERITAGE LANE AREAS SANITARY SEWER ASSESSMENT ROLL ^ u pursuant to proper notice duly given as required by law, the Council has met NOW, THEREFORE, BE IT RESOLWD, by the City Council of Orono, Minnesota: Such proposed assessment, a copy of which is attached hereto and made a part hereof is hereby accept^ md shall comtitute the special assessment against the lands named therein, Md each tract of land therein included is hereby found to be benefitted by the proposed improvement in the amount of the assessment levied against it. ^ ^ Such assessment shall be payable in equal annual installments extending over a period of 15 ms ‘n January1998 and shall bear interest at the rate of 8% per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1998. To each subsequent installment when due shall be added interest for one year on all unpaid installments. ^ The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accmed to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of this resolution, and he may, at anytime thereafter, pay to the City Treasurer the entire amount of the ^sessment remaimng unpaid, with interest accrued to December 31 of the year in which such payrnent «s made. Such payment must be made before November 15 or interest v.i\\ be charged through December 31 of the next succeeding year. L. Contracting, Inc., Medina, Minnesota is the lowest responsible bidder. Minnesota: NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, 1.The Mayor and Clerk are hereby authorized and directed to enter into a construction contract with G. L. Contracting, Inc., Minneapolis, Minnesota, in the name of the City of Orono for the installation of sanitary sewer improvements in the Shoreline Drive, Heritage Drive and Heritage Lane areas according to the plans and specifications therefor approved by the City Council and on file in the office of the City Clerk in the amount of $279,194.07 which includes change order number one. 2. PURPOSE. Pursuant to Minn. Stat. § 471.59 the parties to this Agreement intend to jointly undertake certain improvements to Ferndale Road between County Road 6 and Highway 12 (the "Project"). 2. FEASIBILITY REPORT. Bonestroo, Rosene, Anderlik & Associates, Inc. ("Bonestroo") has prepared a feasibility report on the Project dated April 8, 1998. The feasibility report is approved subject to the following: • Street Width: 28 feet wide with an additional turn lane at County Road 6. • Walk: 8 feet wide immediately adjacent and along the east curb. • Curb: vertical curb. 3. PLANS AND SPECIFICATIONS. Plymouth shall contract with Bonestroo to prepare plans and specifications for the Project consistent with Minnesota Department of Transportation state aid standards, the feasibility report, and this Agreement. The plans and specifications must be approved by both parties before proceeding to bidding. 4. RIGHT-OF-WAY ACQUISITION. Each city shall be responsible for acquiring at its own cost any additional easements necessary for Project construction within its corporate boundaries. 5. BIDDING AND CONTRACTING. Plymouth shall prepare necessary contract documents and bid the Project consistent with the requirements of Minn. Stat. Chapter 429. If an acceptable bid is received, Plymouth shall award a contract for the Project and shall administer the contract. Plymouth may approve change orders consistent with the plans and specifications and Minn. Stat. Chapter 429. Plymouth will provide to Orono, at the earliest possible time, information regarding potential change orders and approved change orders. 6. COST SHARING. Excluding staff time and the cost of right-of-way acquisition, if any, the cost of the Project shall be allocated fifty percent (50%) to Plymouth and fifty percent (50%) to Orono. Project costs include: preparation of 63388.03 RNK;i08/19/98 feasibility report, preparation of plans and specifications, bidding, contract . contract administration, engineering, and construction costs. Plymouth will make i i payment of the Project cost on behalf of the parties. Upon presentation of an itemized claim by Plymouth to Orono, Orono shall reimburse Plymouth for its share of the cost incurred under this Agreement within thirty (30) days from the presentation of the claim. If any portion of an itemized claim is questioned by Orono, the remainder of the cliion shall be promptly paid, and accompanied by a written explanation of the amounts m question. 7. WAIVER. On May 29,1998, the City received a letter from Officer Thornton's physician indicating that due to Officer Thornton's medical condition, his physician considers him to be completely disabled from work as a police officer. His doctor has indicated he cannot perform activities which would require excessive physical exertion such as running or jumping. Additionally, acute stressful situations would be poorly tolerated. Officer Thornton has indicated he would return to work with the City if the City provided a position that he could perform within his medical restrictions. The Police Department does not have work available that would be within his medical restrictions. There are many laws, regulations and requirements that need to be followed as the City determines and pursues a course of action regarding Officer Thornton. These include the Family and Medical Leave Act, Workers' Compensation, Veteran's Preference, the Americans with Disabilities Act, and the Police Officer Collective Bargaining Agreement. Family and Medical Leave Officer Thornton used up his remaining sick leave benefits in late March. Since then. Officer Thornton has been on a leave of absence without pay. Beginning on April 7, the City has provided Officer Thornton with leave benefits as required by the Family and Medical Leave Act. These benefits are a 12 week leave during which the City has continued to pay Officer Thornton's health insurance premiiuns. Officer Thornton's Family and Medical Leave Act leave benefits will expire on June 30, 1998. Workers' Compensation Claim Officer Thornton has made a workers' compensation claim based on his claim that his medical condition is work related. The City's third party workers' compensation administrator has preliminarily denied the claim. However, Officer Thornton is continuing to pursue the claim. If the claim is found to be valid, the City, through its workers' compensation insurance, would be responsible for providing substantial workers’ compensation benefits. ’ • Request for Council Action continued Page 2 June 26, 1998 Update Regarding the Status of Officer Mark Thornton Veteran’s Preference Because Officer Thornton is a veteran, any action regarding a termination requires that he be provided with a notice of his veteran's preference rights. Officer Thornton may have the right to a veteran's preference hearing. The hearing would involve a determination as to whether the termination is justified. Upon receipt of the notice. Officer Thornton has 60 days within which to indicate whether he wants a hearing. The hearing would involve a hearing panel whose determination would be binding on the parties. Grievance Process Under the Police Officer Collective Bargaining Agreement Officer Thornton has the right to file a grievance regarding the City's termination action. The final step of the grievance process is an arbitration process in which a third party arbitrator makes a determination as to whether the City's termination action was conducted properly and with cause. The decision of the arbitrator is binding on both parties. Staff Recommendation It is staffs recommendation that when Officer Thornton's 12 week Family and Medical Leave Act leave expires on June 30,1998, the City will provide a letter to Officer Thornton indicating that due to his inability to perform the duties of a police officer he is being terminated from his police officer position, and notifying him that he may have rights under the Veteran's Preference Act. COUNCIL ACTION REQUESTED: Motion to authorize the City Administrator to commence the termination process regarding Mark Thornton, including notifying Officer Thornton that he may have rights under the Veteran's Preference Act. Lfn ^ Orono, and live on West Ferndale Road not far from Woodhill's main entrance on Highway #15. As a member and neighbor of Woodhill, recent months of the high level of danger involved in accessing Highway #15 from West Ferndale Road, the Woodhill entranL, and Orono orchard Road. This is not a good situation as you all well know. Brooks, are in their Lake. (They are out of town for a few weeks, and would otherwise be writing this letter themselves.) They use Woodhill Country Club frequently; the normal route for them is Old Long Lake Road to Highway 12 to Orono Orchard to Highway 15. They always used the Woodhill Avenue entrance when it was trio'fo^th " significantly shorter and safer HiaLav Given today's dangerous situation on ighway #15, they would be subjected to far less they were able again to use Woodhill Avenue. For the second time; Orono won a grant to preserve open space. The city was awarded $75,000 by the Department of Natural Resources through its Natural and Scenic Areas grant program. The grant requires these funds to be matched by local money, a task, that the Saga Hill Preservation Society has taken on. This is the third and perhaps final stage in a project that has been a good example of public/privale cooperation. The City of Orono has three times listened to and cooperated with citizens who wish to preserve open space in the crowded western side of Orono. The city’s first cooperative gesture was to acquire 9 plus acres from Hennepin County. This will become a sorely needed active park, where children can play. This future playground and ballficld will serve the scores of children living in Orono and across the street in Minnetrista. Since then, the City has twice applied for DNR funds to ocquixe land that will be protected as open space in perpetuity. The first acquisition brought 14 acres of woods and meadow to the public. Now, 8 more wooded acres will be acquired, presers'cd for wildlife and passive pursuits. The Saga Hill Preservation Society has been working productively with the city for more tlian tluce years. At all times, council members and staff have been cooperative, open and enthusiastic. Mayor Gabriel Jabbour and council member Richard Flint have personally spent long hours creating a combination park and space project that residents of our city will enjoy for generations to come.
