A RESOLUTION APPROVING ' A SUBDIVISION OF A LOT LINE REARRANGEMENT . . i � FILE N0.13-3613 WHEREAS,the City of Orono is a muniapal corporation organized and existing i ' under the laws of the State of Minnesota; and . ; �• WHEREAS, the C'ity Council of Orono (hereinafter'City Coundl') has adopted � �• subdivision regulaticns for the orderly, ecAnomic and safe development of land within the City; ' ; and . WHEREAS,Gabrlel E Jabbour,a single person(hereinafter the`Ou►mer")is the ' , owner of the property located at 430 Big Island within the Cfty of Orono(hereinafter"City'�and i legally described as follows: ' . Lots 2 and 3 Scxivers Subdivision of Lot E, Morse Island Park, Hennepin i , County,Minnesota(hereinaftar"430 Big Island°);and � � • i , VYHERF�►S� Gabriel E. WHEREAS,the Owner has submitted an application for a lot line rearrangemeM � involving 430 Big Isiand,440 Big Island, and 450 Big Island in order to combine portions of 440 • Big Island with 430 Big Island ar►d 450 Big Island and eliminating one Big Istand Record Lot; , and � ' I i YVHEREAS,after due published and mailed notice in aocordance with Minnesota i ! Statutes 462.358 et seq. and the City of Orono Zoning and Pianning Codes, the Orono i Planning Commission heid a public hearing on the lot line rearrangemeM on Juty 15, 2013 at ; ' which time ail persons desiring to be heard conceming this application were given the I ' i , I I � � ; I • . I I opportunity to speak theroon;and � WHEREAS, the Orono City Counal reviewed the proposed lot line j •rearrangement at a regular meeting held on August 12, 2013 and makes the following findings � with regards to the proposed lot line rearrangement: i FINDINGS i 1. This application was reviewed as Zoning Flle#13-3613. i , 2. 430 Big Island is currently known as Big Island Record Lot#30. it is a vacant lakeshore , property containing 44,537 square feet or 1.02 acres in area. i � j 3. 440 Big Island is currently known as Big Island Record Lot#24. tt is 47,762 square feet � or 1.11 acres in area. A smail cabin,two small sheds and a septic system exist on the ' property. The property straddles the platted right-of way Massasolt Avenue/Moslin Avenue. � 4. 450 Big Island is known as Big Island Record Lot#27. The property is 46,661 square ; feet or 1.07 acres in area. A cabin,smail shed and septic system currenUy exist on this � property. 5. Following the lot line rearrangement 440 Big lsland which is shown as Parcel 2 on Exhibit A (the submitted survey dated 07/30/2013)will have 68,776 square feet in area � or 1.57 acres in area; and 450 Big Island which is shown as Parcel 1 on Exhibit A will � have 71,184 square feet or 1.63 acres in area. � 6. Following the lot line rearrangemerrt 430 Big Island,othervvise known as Record Lot#30, will cease to exist. ' � 7. Because this is a lot li�e rearrangemerrt which results in no additional lots,na paric fee or � stortnwater trunk fee will be required. i 8. Dedication of drainage and utility easemerrts are not required as this is not a new plat. 9. The proposed lot line rearrangement will not resuft in making any of the structures on i either property non-conforming. I � 10.Resolution No. 1548�regarding the establishment of Record Lot#30 will be extinguished i if necessary. ( z�R O�' � � CONCLUSIONS,ORDER AND CONDITIONS � NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the � findings noted above, the City Counai of the City of Orono hereby gra►its the lot line ' i rearrangemerrt of the above referenced properties based on�e lot line rearrangemerrt survey ; dated 07/30/2013 by Advance Surveying&Engineering Co., attached as Exhibit A, subJect to � the followin�condi�ons: � i � � 1. The Owner shall file the appropriate deeds reflecting the new legal descriptions for each � property(subject to City Attomey approval)with the Hennepin Courrty Recorder's OFfice ; and/or Registrar of Tdles Office on or before August 12, 2014, or the�approval granted by this resalution shall expire.
