landscaping improvements for the new home where 1,650 cubic yards was approved with

1. This application �vas revie�vc�d �s Zoi�ing F�le �04-3042.
2. The properiy is located in the LR— 1B, O�ie Family Lalteshore P�esiciential
�Distriet wllich requires a minimun� lot area of one (1) acre. The
a��plicants' property is 1.691 acres in area.
3. The Plannina Commission reviewed this application at a public hcaring
held on October 19, 2004 and recommended approval of the after-the-fact
conditional use pe�rmit based on the followin� findings:
a. The site is large enoli�h to support the amount of fill ���ithout
drastically changing the character of the neighborhood.

4. Tlze City Gouncil has considered tlzis application including tl�e ii�idinas
and recommendation of the Plaiuli�zg Conimission, reports by City staff,
commei�ts by the applicants ancl the public, aud the effect of the proposed
after-the-fact conditional use pern7it oi1 the health, safe�ty and welfare of
llle C01111]1L1111�}�.
5. Tl�e City Council finds that the- conditions existing on this }n�operty are
peculiar to it and do not apply generally to other property in this zoilin�
district; that granting the after-the-fact conditional use pem�it would not
adversely affect traffic conditions, light, air noi- pose a fire l�azard or other
danger to nei;hboriu� propei-t�; but is necessary to preserve a substantial
property right of the applicants; and ���ould be in l:eeping �vith tl�Ze spirit
and inient of the Zonii7� Code aud Coinprehei�sive Plan of tl�e City.
CO�CL�ISIONS, OI�I)ER.�ND �OIVDITIONS
Eased upon one or iuore of tl�e above findi�igs, the Orono Lity Co�ulcil hereby
grants an after-the-lact conditional use perniit per Municipal Zoning Code Seclion 78-
12�6 to allo�� 3,940 cubic yards of fill otz �tlie properry in conjunction �vith tlle
landscaping improven7ents for the ne�v ?Zome where 1,650 cubic yards �vas approved �vith
thc bciilding pcn��it and 500 cubic yards rec�uires approval of a conditional use pen7iit,
subject to the follo�viizg conditions:
1. Coul�cil approval is based on the site plan sub�l7itted by Che applicailts and
aiulotated by City staff, attached to this Resolution as E�hibit A. Auy
amendments �o the site plan whicli are no't in coilforniity with City codes �vill
require further PlaiulinQ Conlinission and City Cotuzcil review.

?. The site improv�.ments shall also be suUject to compliance with of the City
Engineer comnlents contained in his letter dated November �0, 2004.
3. Tlle site worl� s,hall be conlpleted prior to December 31, 2004.
� 4. Upoi1 conlpletion of the site inlprovements an as-built sluvey shall be submitted
for review against the approved plan. Upon approval of tl�� as-built survey the
City shall issue a final Certificate of Occupancy.
5. Aui�horities ��anted by this resolution run �vith I;he property not ���ith the
appl.icants, bt�t ar� p�nnissive only and nnist be e�ercised by oUtainin� a building
pernzit for the new constructiolz �vithin one year of the date of Council approval,
or th.e after-the-fact conditional use pcmlit will expire on that date (DecemUer 13,
2005).
6. Violation c�f or non-compliance with any of the tei�lis and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any auihority granted herein, and shall be p�u�isl�able as a nlisdemeanor.
7. The undersigned applicants have read, �ulderstand and hereby agree to the tenns
of this resohttion aud on behalf of the applicants and the applicants' heirs,
successors aizd assi�ns, hereby agree to tl�e recording ol this resolutioil i�l the
cllain of title of the property.
