NE Minneapolis, MN 55413 Re: Proposed Lot Line Rearrangement Subdivision 1535-1595 Bohn's Point Road Dear Mr. Cornelius: The City of Orono is in receipt of a survey from Gronberg &Associates, Inc. dated November 5, 2004, depicting a proposed lot line rearrangement between 1535 Bohn's Point Road (PINS 08-117- 23 44 0014) and 1595 Bohn's Point Road (PINS 08-117-23 44 0015). The information provided on the survey indicates that each resulting lot will meet the minimum 1.0 acre lot area and minimum 140' lot width requirements of the LR-1B Single Family Lakeshore Residential Zoning District. It appears from information available in City files that the proposed transfer of the triangular parcel will have no negative impacts regarding setbacks or hardcover limits. Orono Subdivision Code Section 82-2, the definition of"Subdivision", states that "...the adjustment of a lot line by the relocation of a common boundary as long as each of the two resulting lots meets the requirements of Chapter 78 (the Zoning Code)" is not considered to be a subdivision, and is not subject to the formal subdivision process. My conclusion is that your proposed lot line rearrangement can be approved administratively. The only issue for further discussion is that in such situations as this, the City nornlally requires that a new drainage and utility easement be granted 5 feet either side of the new lot line. The City leaves it up to the affected property owner to request formal vacation of the existing easement. The downside of not requesting vacation is that the public drainage and utility rights to use that easement remain intact. Since the existing easement would now be located within your property rather than at its boundary, there is a potential for disruption of landscaping, etc, should a utility choose to place a line within that easement. You would have to provide a description of the easement to be vacated. The application fee is $600, and the process takes approximately 2 months. I will be happy to go over the application requirements in more detail if you wish to proceed with such a vacation. In order to proceed with a formal letter administratively approving the subdivision, I will need the following additional items: � 1. Easement document granting the new easement 5' either side of the new lot line. This will have to be granted by both property owners involved in the transaction. 2. Letter of request from each affected property owner requesting administrative approval of the lot line rearrangement. If you have any questions, please contact me at 952-249-4600. I enclose a revised lot line rearrangement survey which properly depicts the 5 foot drainage and utility easements you require. I have determined that it is not necessary to vacate the existing drainage and utility easements. Consequently, I hereby request that you administratively approve the subdivision as shown on the enclosed survey. I enclose my grant to Orono of the 5 foot drainage and utility easement. Each of the two existing parcels will,after the lot line rearrangeinent,meet the requirements of the Zoning Chapter as to area,width,and setbacks to existing features.No non-conformities are created, and no variances are required for continued use of either parcel. Further,you have provided me with documentation that the properiy owners will be providing a drainage a�ld utility easement along the new lot line to replace the existing easement along the current lot line. Therefore,this letter shall serve as certification per Minnesota Statutes 462.358, Subd. 3(b)that the subdivision regulations of the City of Orono do not apply to your proposed lot line rearrangement,as shown on the certificate of survey by Mark S.Gronberg of Gronberg&Associates,Inc.dated 1/4/O5. You may proceed to file the lot line rearrangement documents and the easement with Hennepin County.
