A RESOLUTION APPROVING
A SUBDIVISION OF A LOT LINE REARRANGEMENT
FILE NO. 14-3683
WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of Orono (hereinafter "City Council") has adopted
subdivision regulations for the orderly, economic and safe development of land within the City;
and
WHEREAS, Irwin L. Jacobs, et al Trust, (hereinafter the "Owner of 1700 Shoreline") is
is the owner of the property located at 1700 Shoreline Drive within the City of Orono
(hereinafter"City") and legally described as follows:
That part of Government Lots 1 and 2, Section 10, Township 117 North, Range 23
which is described as follows to wit: Beginning at a point 6 chains west of the
meander post in the Southeast corner of said Lot 2 in said Section 10; thence
running north 20 chains more or less, to the shore of Round Lake, so-called (now
known as Tanager Lake); thence along and around the westerly and northerly
shore of said Lake to the meander corner in the North shore of said Lake and
between Sections 10 and 11 in said Township and Range; thence North on the
section line between said Sections 10 and 11 to the southerly line of the right-of-
way of the Minnetonka Branch of the Great Northern Railway; thence
Southwesterly along said southerly line of said right-of-way to the point of
intersection of said Southerly line of the said right-of-way with the West line of
said Lot 1; thence turning and running in a straight line in a Southeasterly
direction 654.8 feet, more or less, to a point which is 236.8 feet east of the West
line of said Lot 2, and at the same time 304 feet South of the North line of said Lot
2, thence South on a line parallel with and distant 236.8 feet East from the West
line of said Lot 2, 1016 feet, more or less, to the North shore of Lake Minnetonka;
thence easterly along the said shore of said Lake Minnetonka to the place of
beginning, ALSO Lot 2, Block 1, Millston, Hennepin County, Minnesota (hereinafter
the "Jacobs Property"); and
WHEREAS, Rodney P. Burwell and Barbara Elaine Burwell, husband and wife,
(hereinafter the "Owners of 1100 Millston") are the owners of the property located at 1100
Millston Road within the City of Orono (hereinafter "City") and legally described as: Lots, 3, 4
and 5, Block 1, Millston, Hennepin County, Minnesota (hereinafter the "Burwell Property");

WHEREAS, the Owners of 1100 Millston and the Owner of 1700 Shoreline have
collectively made application to the City for approval of a lot line rearrangement which would
relocate the lot boundary line between the properties; and
WHEREAS, after due published and mailed notice in accordance with Minnesota
Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono
Planning Commission held a public hearing on the lot line rearrangement on September 15,
2014 at which time all persons desiring to be heard concerning this application were given the
opportunity to speak thereon; and
WHEREAS, for the sake of clarity, the properties after the completion of the lot
line rearrangement shall hereinafter be referred to as "the revised Jacobs property" and "the
revised Burwell property"; and
WHEREAS, the Orono City Council reviewed the proposed lot line
rearrangement at a regular meeting held on October 13, 2014 and makes the following findings
with regards to the proposed lot line rearrangement:
FINDINGS
1. This application was reviewed as Zoning File #14-3676.
2. The Jacobs Property contains 33.57 acres in area, approximately 970 feet in width and
currently contains a single family home and several accessory structures.
3. The Burwell Property contains 11.11 acres, and has approximately 400 feet in width.
4. The Jacobs Property and the Burwell Property are both served by private wells and
private septic systems.
5. This application contemplates a lot line rearrangement to transfer a 2.52 acre portion of
the Jacobs Properly to the Burwell Property. The 2.52 acre portion of property to be
exchanged contains an existing caretaker house, greenhouse and a garage in addition
to a septic system serving the caretaker house.
6. Following the lot line rearrangement the revised Jacobs Property will contain 31.05 acres
in area and approximately 670 feet of width; and the revised Burwell Property will
contain 13.63 acres in area and approximately 700 feet of width.
7. The lot line rearrangement will not result in the creation of a nonconformity.

8. The 2.52 acre portion of the Jacobs Property to be transferred to the Burwell Property is
not intended to be a standalone building lot. Because this is a lot line rearrangement
which results in no additional lots, no park fee or stormwater trunk fee will be required.
9. The following documents are known to be recorded against the Jacobs Property:
a. Resolution No. 2897, regarding CUP and variance permitting a 1,749 s.f. guest
house which will remain within the revised Jacobs property.
b. Resolution No. 2907, regarding variances allowing a 2,604 s.f. greenhouse which
will now be located within the revised Burwell property.
c. Resolution No. 3320, regarding a CUP and variance to permit a 1,088 s.f.
caretaker house (guest house) which will now be located within the revised
Burwell property.
d. Resolution No. 3428, regarding a variance to allow a 160 s.f. guardhouse which
will remain within the revised Jacobs property.
It is the intent of the City that the approvals and conditions of Resolutions No. 2907 and
No. 3320 no longer be applicable to the revised Jacobs property, but remain in effect
with respect to the revised Burwell property.
CONCLUSIONS, ORDER AND CONDITIONS
NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the
findings noted above, the City Council of the City of Orono hereby grants the lot line
rearrangement of the above referenced properties based on the lot line rearrangement survey
dated 08/26/14 by Mark Gronberg of Gronberg & Associates, attached as Exhibit A; subject to
the following conditions:
1. The 2.52 acre portion of the Jacobs Property to be transferred shall not be considered a
standalone buildable lot, and shall be legally combined with the revised Burwell property.
2. The Applicant shall file the appropriate deeds reflecting the new legal descriptions
(subject to City Attorney approval) with the Hennepin County Recorder's Office and/or
Registrar of Titles Office on or before October 13, 2015, or the approval granted by this
resolution shall expire.

3. Resolution No. 2907 and Resolution No. 3320 relate specifically to the greenhouse and
caretaker structures on the 2.52 acre portion of the Jacobs Property to be transferred to
and combined with the Burwell Property, and the approvals for those structures shall
henceforth be applicable to the revised Burwell property but not the revised Jacobs
property. Further, Resolution No. 2897 and Resolution No. 3428 relate specifically to
structures that will remain in the revised Jacobs property and are not intended to apply
to the revised Burwell Property.
