HomeMy WebLinkAboutResolution 6446 > Y r �O ♦O C ITY OF ORONO RESOLUTION OF THE CIT'Y COUNCIL � '� 644 � � 1 �' G N O. `A'�ESH��� A RESOLUTION FINDING NO POTENTIAL FOR SIGNIFICANT ENVIRONMENTAL IMPACTS AND MAKING A NEGATIVE DECLARATION ON THE NEED FOR AN ENVIRONMENTAL IMPACT STATEMENT (EIS) 405 North Arm Drive (AKA Lakeview) Property Identification Numbers: 06-117-23-32-0003; 06-117-23-33-0005; 06-117-23-33-0007; 06-117-23-34-0002; and 07-117-23-12-0001 WHEREAS, the City of Orono (hereinafter "City") is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the property in question consists of approximately 149 acres, operated as a golf course since the late 1950s; and WHEREAS, the current land use category applied to the subject property in the Orono 2008-2030 Community Management Plan (CMP) is "Parks Recreational and Open Space"; and WHEREAS, the current owner has applied for an amendment to the CMP to change the land use designation from "Parks Recreational and Open Space" to "Rural Residential"; and WHEREAS, the conversion of such land from golf course to residential raises the potential for alterations to the environment that require additional study; and WHEREAS, in January, 2014 the Orono City Council found that the proposed Lakeview residential project qualified for such study under the process for an Environmental Assessment Worksheet (EAW) under Minnesota Rules 4400 et. seq.; and WHEREAS, an EAW study was commenced by the project proposer; and WHEREAS, the draft EAW was published in the EQB Monitor pursuant to Minnesota Rules on July 7, 2014; and WHEREAS, the draft EAW was distributed to all required parties under the Rules, as well as to all parties requesting notification; and Page 1 of 2 t : �O� V� C ITY OF ORONO RESOLUTION OF THE CITY COUNCIL ��'lq �,G' No. 644 � kESH�� WHEREAS, the draft EAW was published on the City's website, and notification was made to the City's official newspapers; and WHEREAS, agency and individual comments were received on the draft EAW during the required comment period, which officially closed on August 7, 2014; and WHEREAS, supplemental information in response to the received comments was prepared and provided to the City; and WHEREAS, the City has reviewed all relevant information, comments, responses, and subsequent submissions; and WHEREAS, based on the results of the investigations and studies made as a part of the EAW, no potential for significant environmental impacts has been discovered; NOW, THEREFORE, BE IT RESOLVED that the Orono City Council, in light of the above noted facts, as well as the applicant's materials, staff reports, citizen comments and submittals, and all other facts and information supplied and considered as a part of the record of this proceeding, hereby finds that the Lakeview residential project, as regulated by existing zoning, environmental, construction, and other laws and permitting requirements, holds no potential for significant environmental impacts, and further makes a `negative declaration" under applicable Minnesota Rules on the need for an Environmental Impact Statement (EIS).
